The provisions of this article imposing a time limit on parking shall not relieve any person of the duty to observe other and more restrictive provisions prohibiting or limiting the stopping, standing or parking of vehicles as set forth in N.J.S.A. 39:4-138, any other New Jersey statute or as hereinafter provided.
No person shall park a vehicle at any time upon any of the streets or parts thereof described in Schedule I attached to and made a part of this chapter.

A. 
Upon the declaration of an emergency, there shall be no parking upon streets or sections of streets where temporary emergency no-parking signs are displayed. The Chief of Police or, in his absence, the ranking police officer is authorized to declare an emergency and to direct the posting of said emergency no-parking signs when weather conditions, accidents, fires or public celebrations dictate or require the avoidance of hazards or other conditions which interfere with the free flow of traffic. Notification that the emergency no-parking signs are being or will be posted shall be given to the operator or owner of any vehicle which has been parked prior to the posting of the signs.
B. 
The effectiveness of this section is contingent upon the signs being erected as required by law.
C. 
Any unoccupied vehicle parked or standing in violation of this section shall be deemed a nuisance and a menace to the safe and proper regulation of traffic and any police officer may provide for the removal of such vehicle. The owner shall pay the reasonable costs of the removal and storage which may result from such removal, before regaining possession of the vehicle.
No person shall park a vehicle between the hours specified in Schedule II of any day, except Sundays and public holidays, upon any of the streets or parts of streets described in said Schedule II attached to and made a part of this chapter.

No person shall stop or stand a vehicle between the hours specified in Schedule III of any day upon any of the streets or parts of streets described in said Schedule III attached to and made a part of this chapter.

A. 
Except as set forth herein, no person shall park a vehicle for longer than the time limit shown in Schedule IV, as may be amended by Borough Council from time to time, of any day as listed in said Schedule IV, upon any of the streets or parts of streets described in Schedule IV attached to and made a part of this chapter. The Borough Council may by resolution relax the time limits on street parking restrictions contained herein and in § 139-26, Schedule IV: Time Limit Parking, when it deems necessary for holidays, emergencies, construction or for other good cause.

B. 
Residents parking a vehicle in front of his/her own home with a valid, properly affixed residential parking decal shall be exempt from the time limit parking restrictions set forth in Schedule IV.
C. 
Residents of 49 South Passaic Avenue (Block 118, Lot 37) with a valid, properly affixed residential parking decal may park along South Passaic Avenue from 6:00 p.m. to 8:00 a.m. in accordance with Schedule IV.

D. 
Caregiver parking permits may be issued to residents who require on-going medical care. A vehicle bearing a valid caregiver parking permit shall be exempt from the time limit parking restrictions set forth in Schedule IV.
E. 
The parking of a vehicle which is necessary for the completion of any service or construction work being performed within the immediate vicinity of where the vehicle is parked shall be exempt from the time limit parking restrictions set forth in Schedule IV.
F. 
The fees required for any permit or decal under this chapter shall be set annually by resolution of the Borough Council.
G. 
Application for residential parking or caregiver parking decals or permits under this chapter may be made in writing on forms provided by the Borough Clerk or his/her designee. The Borough Administrator is hereby authorized to establish reasonable rules and procedures as necessary for the issuance and control of permits pursuant to this chapter.

H. 
Nothing herein contained shall be construed to permit overnight parking on any Borough street in violation of § 195-15.

A. 
The areas listed herein and on Schedule V of § 139-27 are hereby designated as handicapped parking spaces for the exclusive use of persons who have been issued special identification cards or plates or placards by the Division of Motor Vehicles, or a temporary placard issued by the Chief of Police.
B. 
Handicapped parking spaces shall be not less than 12 feet wide and not less than 20 feet long in parking yards and not less than 22 feet long on streets.
C. 
Handicapped parking spaces shall be so located so as to allow room for individuals in wheelchairs or individuals on braces, canes, or crutches to get in and out of either side of an automobile.
D. 
Removal of snow and ice; time limit; violations and penalties.
(1) 
Owners of premises, whether public or private, having parking spaces reserved for handicapped drivers must clear said handicapped parking spaces and access thereto of snow and/or ice
(2) 
No owner or operator of premises, whether public or private, having parking spaces reserved for handicapped drivers and no tenant, contractor or other person may block access to such parking stalls reserved for handicapped drivers by the plowing, piling or placement of snow or ice in such spaces.
(3) 
Handicapped parking spaces must be cleared of snow and ice within 12 hours after the same shall fall or form thereon.
E. 
Violations and penalties. The penalty for violating this section shall be a fine of $250 for the first offense and a fine of at least $250 plus a maximum of 90 days of community service for all subsequent offenses.
