A. 
Definitions. As used in this chapter, the following terms shall have the meanings indicated:
BOD (DENOTING "BIOCHEMICAL OXYGEN DEMAND")
The quantity of oxygen utilized in the biochemical oxidation of organic matter under standard laboratory procedure in five days at 20° C., expressed in milligrams per liter.
BUILDING DRAIN
That part of the lowest horizontal piping of a drainage system which receives the discharge from soil or waste drains or pipes inside the walls of the building and conveys it to the building sewer beginning five feet outside the inner face of the building wall.
BUILDING SEWER
The extension from the building drain to the public sewer or other place of disposal.
COLLECTION FACILITIES
The sewers, manholes and appurtenances which collect wastewaters from individual, commercial or industrial building sewers and convey these wastewaters to common treatment or other disposal facilities.
DEC
The New York State Department of Environmental Conservation.
EPA
The United States Environmental Protection Agency.
GARBAGE
Solid wastes from the preparation, cooking and dispensing of food and from the handling, storage and sale of produce.
GRAB SAMPLE
A sample which is taken from a waste stream on a one-time basis with no regard to the flow in the waste stream and without consideration of time.
HEALTH DEPARTMENT
The New York State Department of Environmental Conservation and/or the Erie County Health Department, as applicable.
INDUSTRIAL WASTES
Any liquid, gas or solid waste substance, or a combination thereof, resulting from any process of industry, manufacturing, trade or business, as distinct from sanitary sewage.
INDUSTRIAL WASTEWATER
The liquid and water-carried industrial wastes from commercial buildings and industrial facilities.

NATURAL OUTLET
Any outlet into a watercourse, pond, ditch, lake or other body of surface water or groundwater.
NPDES (NATIONAL POLLUTANT DISCHARGE ELIMINATION SYSTEM)
The federal system through which permits are issued to regulate discharge into navigable waters from all point sources of pollution, including industries and municipal wastewater treatment plants.
PERSON
Any individual, firm, company, association, society, corporation or group.
pH
The logarithm of the reciprocal of the weight of hydrogen ions in grams per liter of solution.
PLUMBING INSPECTOR
The official of the Town of West Seneca duly appointed by the Town Board. The Plumbing Inspector shall be responsible for the review and approval of all plumbing permit applications and required plumbing designs, diagrams and layouts and for the issuance of all plumbing permits. The Plumbing Inspector shall be responsible for the inspection and approval of all building plumbing, building drain and building sewer construction and shall be responsible for compliance of all such plumbing installations with the Plumbing Code and this chapter.
POTW (PUBLICLY OWNED TREATMENT WORKS)
A treatment works as defined by Section 212 of the Federal Water Pollution Control Act, also known as the "Clean Water Act," as amended (33 U.S.C. § 1292), which is owned by the Town of West Seneca, any one of the various Erie County Sewer Districts, the Buffalo Sewer Authority or any other agency or municipality receiving or contributing wastewater from or to the Town of West Seneca POTW. This definition includes collection facilities, pumping facilities, treatment facilities and other disposal plants, but does not include pipes, sewers or other conveyances not connected to a facility providing treatment. For the purposes of this chapter, "POTW" shall also include any sewers that convey wastewaters to the Town POTW from persons outside the various Town sanitary sewer districts who are, by contract or agreement with a Town sanitary sewer district, users of the Town's POTW, and shall also include a POTW receiving or treating sewage generated within or conveyed by the Town of West Seneca by contract or agreement.
POTW TREATMENT PLANT
That portion of the POTW designed to provide treatment to wastewater.
PROPERLY SHREDDED GARBAGE
The wastes from the preparation, cooking and dispensing of food that have been shredded to such a degree that all particles will be carried freely under the flow conditions normally prevailing in public sewers, with no particle greater than 1/2 inch in dimension.
PUBLIC SEWER
A sewer in which all owners of abutting properties have equal rights and which is controlled by public authority.
SANITARY SEWAGE
A combination of the water-carried wastes from residences, business buildings, institutions and industrial establishments, together with such groundwater, surface water and stormwater as may be present. The admixture with sanitary sewage of industrial waste as hereinbefore defined shall also be considered sanitary sewage within the meaning of this definition.
SANITARY SEWER
A sewer which carries sewage and to which stormwater surface water and groundwater are not intentionally admitted.
SEWER
A pipe or conduit for carrying sewage.
SEWERAGE FACILITIES
See "POTW."
SIGNIFICANT INDUSTRIAL USER
Any industrial user of the POTW who has a discharge flow of 25,000 gallons or more per average workday or who has a flow greater than 5% of the flow in the Town's wastewater treatment system or who has in his wastes toxic pollutants as defined pursuant to Section 307 of the Clean Water Act or who is found by the Town, the DEC, the EPA or other appropriate regulatory agency or authority to have significant impact, either singly or in combination with other contributing industries, on the POTW, the quality of sludge, the system's effluent quality of sludge, the system's effluent quality or air emissions generated by the system.
SLUG DISCHARGE
Any discharge of water, sewage or industrial waste which contains pollutant concentrations greater than those listed in § 97-29 of this chapter or any flow or discharge not listed in § 97-29 which contains any pollutants exceeding by more than five times the dischargers average flow or concentration during normal operating hours.
SPDES (STATE POLLUTANT DISCHARGE ELIMINATION SYSTEM)
The state system through which permits are issued to regulate discharge into navigable waters from all point sources of pollution, including industries and municipal wastewater treatment plants.
STORM SEWER or STORM DRAIN
A sewer which carries stormwater and surface water and drainage but excludes sewage and industrial wastes.
SURCHARGEABLE USER
Any user of the Town's facilities whose discharge contains in excess of 250 mg/l of five-day biochemical oxygen demand (BOD), 250 mg/l total suspended solids and/or 5.0 mg/l total phosphorus (15.35 mg/l total phosphate).
SUSPENDED SOLIDS
Solids that either float on the surface of or are in suspension in water, sewage or other liquids and which are removable by filtering.
TOWN
The Town of West Seneca, New York.
TOWN BOARD
The Town Board of the Town of West Seneca.
TOWN ENGINEER
The duly appointed professional engineer, licensed by the State of New York, engaged by the Town of West Seneca to represent the Town's interest as Town Engineer.
WASTE
Any liquid, solid or gaseous substance that may be discharged into a public sewer.
WATERCOURSE
A channel in which a flow of water occurs, either continuously or intermittently.
WSPDES
The Town system through which permits are issued to regulate the discharge of industrial waste into any sanitary sewer under the jurisdiction of the Town of West Seneca, or in a contracted service area.
B. 
Usage. "Shall" is mandatory; "may" is permissive.
