When required by the Town, the owner of any property served by a building sewer carrying industrial wastes shall install a suitable control manhole in the building sewer to facilitate observation, sampling and measurement of the wastes. Such manhole, when required, shall be accessibly and safely located and shall be constructed in accordance with plans approved by the Plumbing Inspector. The manhole, together with such meters and/or other appurtenances required by the Town, shall be installed by the industrial user at his expense and shall be maintained by him so as to be safe, accurate and accessible at all times.
A. 
Periodic measurements of flow rates, flow volumes and such measurements of quality and other constituents deemed necessary by the Town shall be made on all industrial wastewater discharges at the expense of the industrial user. All sampling, analysis and flow measurements of industrial wastewater shall be performed by recognized independent laboratories or, if approved by the Town, by the laboratory of the industrial user. Prior to submittal of data to the Town Engineer for evaluation, the results shall be verified by a responsible official of the industrial user.
B. 
All measurements, tests and analyses of the characteristics of waters and wastes to which reference is made herein shall be determined in accordance with Standard Methods for the Examination of Water and Wastewater, published by the American Public Health Association, or the Environmental Protection Agency's Methods of Analysis of Water and Wastes, the most recent edition. If no appropriate procedure is contained therein, the standard procedure of the industry shall be used to measure wastewater constituents. Any independent laboratory or industrial user performing tests shall furnish the required test date and/or information on the test methods or equipment used if requested by the Town Engineer.
C. 
The periodic monitoring reports will be signed by an authorized representative of the industrial user. The user will also maintain records of all information resulting from monitoring activities required by this section for a period of three years.
D. 
The sampling, analysis and flow measurement procedures, equipment and monitoring records shall be subject at any time to inspection by the Town.
Authorized employees of the Town of West Seneca, representatives of the Buffalo Sewer Authority or other POTWs receiving or treating sewage generated in the Town of West Seneca, USEPA and/or NYSDEC personnel bearing proper credentials and identification shall be permitted to enter upon all properties, including those in contracted service areas, for the purpose of inspection of pretreatment facilities and monitoring records, flow measurements, sampling and testing of discharges, review and copying of all file records and data pertaining to wastewater discharge monitoring investigation of suspected or reported violations and enforcement in accordance with the provisions of this chapter. All inspections and related activities, as described above, will be conducted by the personnel identified after reasonable notice is given to the user to be inspected, monitored, etc.
