For the purpose of establishing rules and regulations for the construction, alteration, repair and removal of buildings and structures erected or to be erected within the Village and for the purpose of establishing regulations and standards for the installation, maintenance and repair of plumbing and the regulation of similar work in the Village, the Board of Trustees of the Village, as and for its Building Code, hereby adopts and accepts the applicability of the New York State Building Construction Code, including the plumbing standards thereof, for the Village, in accordance with the provisions of § 374-a of the Executive Law of the State of New York,[2] with the additional provisions herein contained, and said New York State Building Construction Code is hereby adopted and incorporated herein by reference as fully as if set forth at length.

A. 
Unless otherwise expressly stated, the following terms shall, for the purposes of this chapter, have the meanings herein indicated:
ALTERATION
As applied to any building or structure, is any change or rearrangement in the structural parts or in the exit facilities, or any enlargement, whether by extending on any side or by increasing in height or by the moving from one location or position to another.
APPROVED
As applied to any material, device or mode of construction, means approved by the Superintendent of Construction, which approval will be given only after satisfactory evidence of impartial tests is submitted to said officer.
BUILDING INSPECTOR
The Superintendent of Construction.
CURB LEVEL
The officially established grade of the curb in front of the midpoint of the lot.
GARAGE, PRIVATE
An accessory building or part of a main building used only for the permitted storage of motor vehicles.
GARAGE, PUBLIC
Any garage, other than a private garage, available for gain and which is used or intended to be used for storage, rental, greasing, washing, servicing or adjusting of automobiles or other motor vehicles.
HEIGHT
As applied to a building or structure, means the vertical distance measured in a straight line from the curb level to the highest point of the roof beams in the case of flat roofs and to the average height of the gable in the case of roofs having pitch.
MULTIPLE-FAMILY DWELLING
Any apartment or tenement building as defined in Chapter 288, Zoning.
OCCUPIED
As applied to any building, shall be constructed as though followed by the words "or intended, arranged or designed to be occupied."
OWNER
Includes his duly authorized agent or attorney, a purchaser, devisee and any person entitled to a vested interest in the property in question.
STORY
That portion of a building included between the surface of any floor and the surface of the floor next above it or, if there is no floor above it, then the space between the floor and the ceiling next above it. A basement shall be counted as a "story" if the ceiling is more than four feet above the level from which the height of the building is measured or if it is used for business purposes or for dwelling purposes by other than a janitor or watchman.
B. 
Any term not defined herein but defined in Chapter 288, Zoning, shall be construed for the purpose of this Code as so defined.
