The use of water for the sprinkling of lawns within the Borough of Closter shall hereafter be regulated so as to provide adequate water pressure for fire-fighting purposes at all hydrants within the Borough of Closter.
The inadequacy of water pressure at any fire hydrant within the Borough of Closter shall be determined by the Bureau of Fire Prevention of the Borough of Closter.
The Bureau of Fire Prevention, in making its determination, shall also ascertain the periods of time during which the lack of water pressure exists at any particular fire hydrant or hydrants within the Borough of Closter. The Bureau of Fire Prevention shall transmit this information to the Mayor for his or her guidance in making the order restricting the sprinkling of lawns.
Upon the determination of the Bureau of Fire Prevention that inadequacy of water pressure exists at any fire hydrant within the Borough of Closter and upon request made by said Bureau to the Mayor, he or she shall declare an emergency to exist within such area and shall forthwith order the discontinuance of the use of water for the sprinkling of lawns in such portions of the Borough of Closter as shall be necessary to relieve such emergency and to provide adequate water pressure in all fire hydrants for adequate fire protection.
In making his or her order restricting the sprinkling of lawns, the Mayor shall set forth the hours or periods of time during which the restriction against the sprinkling of lawns shall apply.
If any person shall be aggrieved by the action of the Bureau of Fire Prevention, an appeal in writing to the governing body may be taken. A hearing thereon shall be had on notice to the members of the Bureau of Fire Prevention, who shall be afforded an opportunity to present any evidence in support of their determination. After such hearing, the governing body may affirm or reverse the action of the Bureau of Fire Prevention by a recorded vote of a majority of the total members thereof.
Any individual or individuals violating any of the provisions of this chapter or any order made in accordance herewith shall, upon conviction thereof, be subject to a penalty as set forth in Chapter 1, General Provisions, Article II, Violations and Penalties, of this Code.
