Required permission (non-utility operations).
No person shall cut, prune, remove, treat, spray, damage, kill or otherwise deliberately adversely affect the health of any tree within a public right-of-way or upon Town-owned property without the prior written consent of the Superintendent of Public Works.
The electric and telephone utilities operating within the Town of Boonton shall have the right to remove trees without prior approval of the Superintendent when an emergency exists and when obtaining prior approval is not practical. At all times, said utilities shall have the right to trim trees when reasonably required for the purpose of ensuring continuous electric or telephone utility service or to avoid danger to the public or electric or telephone utility personnel or equipment.
Planting and tree removal within the public rights-of-way and upon Town-owned property shall be performed by or under the supervision of the Department of Public Works.
