Pursuant to N.J.S.A. 40A:9-136, there is hereby created the position of City Administrator.
A. 
The City Administrator shall be appointed by the Mayor with the advice and consent of City Council in accordance with N.J.S.A. 40A:9-137.
B. 
The term of the office of the City Administrator shall be at the pleasure of the governing body.
C. 
The City Administrator shall receive as salary such sums as may be fixed and adopted by the City Council and the annual Salary Ordinance.[1]

The City Administrator may be removed by a two-thirds vote of the governing body. The resolution of removal shall become effective three months after its adoption by the governing body. In accordance with N.J.S.A. 40A:9-138, the governing body may provide that the resolution of removal shall have immediate effect; provided, however, that the governing body shall cause to be paid to the Administrator forthwith any unpaid balance of his/her salary and his/her salary for the next three calendar months following adoption of the resolution or shall provide for the payment of his/her salary for the next three calendar months following the adoption of the resolution.
The City Administrator shall be chosen on the basis of his/her executive and administrative abilities and qualifications with special regard as to education, training and experience in governmental affairs. Said Administrator shall have received a bachelor's degree from an accredited college or university. (Four years' City administration experience may be substituted for the bachelor's degree). Said Administrator shall be subject to any further qualifications that the Mayor and City Council may establish in its advertising for the position. The person selected shall not be required to be a resident of the City of Egg Harbor City.
Any vacancy in the position of City Administrator shall be filled by appointment by the Mayor and with the advice and consent of City Council.
A. 
The City Administrator shall, under the supervision and control of the Mayor and City Council and to the extent not prohibited by law, have the following duties and responsibilities:
(1) 
To serve as the principal administrative officer representing the Mayor and City Council.
(2) 
To supervise the administration of all departments and offices and consultation with respective committee chairpersons.
(3) 
To represent the City in its relation to the federal, state and county governments and to other municipalities and to evaluate the city's interests in contracts, franchises and other business transactions as assigned by the Mayor and City Council.
(4) 
To keep the Mayor and City Council informed of the financial condition of the City and make special reports thereon as required and to prepare annually a comprehensive report on the financial condition of the city.
(5) 
To study the administrative and other operations of the City and make recommendations for plans and programs to meet the changing needs of the city.
(6) 
To receive and reply to inquiries and complaints concerning City business and to provide information and assistance with respect thereto.
(7) 
To attend all meetings of the City Council and all City Council Committee meetings as requested.
(8) 
To establish and maintain sound personnel practices and maintain appropriate records for all employees. In conjunction with the department chairperson, he/she shall have the authority to recommend to the Mayor and City Council the initial hiring and disciplining of all City employees.
(9) 
To recommend the nature, location and extent of public improvements and to coordinate the execution of the same when authorized by the Mayor and City Council.
(10) 
To implement and enforce the policies of the Mayor and City Council with respect to the compiling and release of public information.
(11) 
To consult with the Mayor and City Council on the preparation of the tentative budget, recording changes, additions and deletions thereto, and to submit final recommendations in the form required by law, together with an analysis of the various items of expenditure and revenue and such explanatory comments as may be required.
(12) 
To maintain a continuing review and analysis of budget operations, work progress and the costs of municipal services.
(13) 
To supervise the disbursement of all City funds before submitting to the Mayor and City Council for final approval.
(14) 
To analyze the cash needs of the City and to recommend to the Mayor and City Council the prudent investment of such funds as temporarily may be in excess of the amounts needed to meet City obligations.
(15) 
To supervise and continually review the city's insurance program.
(16) 
To assist the Mayor and City Council in negotiating contracts for the City as authorized by and subject to the approval of the Mayor and City Council.
(17) 
To act as liaison on behalf of the City with all utility companies serving any portion of the City to be sure that such utilities are providing adequately for the needs of the residents of the city.
(18) 
To assure that the provisions of all franchises, leases, permits and privileges granted by the City are complied with.
(19) 
To require such department to maintain adequate inventory records of all equipment and materials owned and used by the City and to arrange for the disposal of all inadequate or obsolete materials when requested to do so by the Mayor and City Council.
(20) 
To assist the residents of the City in matters within his/her jurisdiction, to maintain a record of complaints submitted to him/her for his/her attention and to take proper steps to remedy the causes for such complaints.
(21) 
To keep the Mayor and City Council currently informed of all matters within his/her jurisdiction by such reports, verbally or in writing, that he/she deems advisable or as may be requested by the Mayor and City Council, and to submit an annual written report of his/her work accomplished at the request of the Mayor and City Council for the benefit of the public, which report will also establish particular goals and objectives for the following year.
(22) 
To perform such other duties as may be assigned to him/her from time to time by the Mayor and City Council.
(23) 
To perform the functions of contracting agent, as that term is defined in N.J.S.A. 40A:11-2(3), on behalf of the City of Egg Harbor City.
B. 
Nothing in this section shall extend authority to the Administrator to administer, supervise, terminate, hire or discipline Police Department personnel. The City Administrator shall have the final authority on all matters of business-related activities of the Police Department, including purchasing and finance.
The City Administrator shall devote full time to the interests of the city. The Mayor and City Council reserve the right at any time to set specific hours for the Administrator by resolution.
Nothing in this article shall derogate from or authorize the City Administrator to exercise the powers and duties of the elected or appointed officials of the City of Egg Harbor City.
