The Pawtucket City Council may grant a license permit for the purpose of permitting carnival and circus exhibitions on publicly owned property after public hearing at least thirty (30) days prior to the date of the scheduled exhibition.

At the time of application for a license permit, the City Clerk will request a preliminary investigation to be made in conformance with Chapter 193, Entertainment, Article I, of the Code of the City of Pawtucket. If the permit is for an animal exhibit, the Animal Control Officer should also conduct a preliminary investigation. The results of these investigations will be reported to the Council at the time of the public hearing.
Upon receipt of application and fee for a license permit the City Clerk shall provide written notice via first class prepaid mail to each resident within a one-hundred-foot radius of the site of the proposed exhibition. Such notice shall include the name and address of the applicant, the address of the site and the place, date and time of the public hearing.
No carnival or circus shall conduct its performance or exhibition before 12:00 noon or after 10:00 p.m. in the evening on any day of the license permit.
License permits under this chapter shall only be granted to carnivals and circuses, the promotion of which is exclusively limited to the financial support of a charitable organization situated and doing business in the City of Pawtucket.
Any license permit application under this chapter may only be denied upon the grounds that the proposed carnival or circus presents a danger to the public health and safety to the residents of the City of Pawtucket.
Any applicant for a license permit under this chapter shall be required to show evidence to the City Clerk of the existence of a public liability insurance policy which shall name the City of Pawtucket as insured against all claims and losses arising out of any activity performed at the proposed site for the duration of the license permit period.
Any license permit issued under this chapter may be revoked by act of the City Council for failure to comply with any municipal or state law related to the operation of a circus or exhibit.
