As used in this article, the following terms shall have the meanings indicated:
AT LARGE
Any dog or other animal when it is off the property of its owner and not restrained by the owner, keeper or another competent person.
BOROUGH OFFICIAL
Any police officer, code enforcement official or animal control official of the Borough of Wilkinsburg.
DOG
The genus and species known as canis familiaris.
OWNER
Any person, group of persons, firms or corporations owning, keeping or harboring a dog or dogs or other animals.
RESTRAINT or RESTRAINED
When a dog or other animal is controlled by leash or chain not exceeding six feet in length.
A. 
No person, whether as owner or keeper, shall permit his dog to run at large upon the public streets or highways of the Borough of Wilkinsburg, sidewalks or other public places, or upon the property of another. A dog shall be restrained by the use of a leash, or a chain not exceeding 6 feet in length, at all times when upon public places, streets and parks.
B. 
Any licensed or unlicensed dog that is found running at large, either upon the public streets or upon the property of a person other than the owner of such dog and is unaccompanied by the owner or keeper, shall be seized and detained, if possible, by a Borough official in accordance with 3 P.S. § 459-302.
A. 
Any dog, cat or other animal which scratches, digs or defecates upon any lawn, tree, shrub, plan, building or any other public or private property, other than the property of the owner or person in charge or in control of such animal, is hereby declared to be a nuisance.
B. 
No person being the owner or in charge or control of any dog, cat or other animal shall permit such animal to commit a nuisance on any school grounds, Borough park or other public property or upon any private property other than that of the owner or person in charge or control of such dog, cat or other animal without the permission of the owner of such property. Where the owner or person in charge or in control of such animal immediately removes all feces deposited by such animal and disposes of same in a sanitary manner, such type of nuisance shall be considered abated.
C. 
Persons with disabilities while relying upon a dog specifically trained to do work or perform tasks for the benefit of the individual shall be exempt from compliance with this section.
A. 
All dogs over the age of three months that are kept, harbored or owned within the Borough of Wilkinsburg must be vaccinated in accord with 3 P.S. § 455.8 by a licensed veterinarian and issued a vaccination certification and metal tag. All dogs must also be revaccinated to remain in compliance with the schedule of vaccinations outlined in 3 P.S. § 455.8.
B. 
No person shall keep, harbor or maintain a dog unless the owner obtains a license from the County of Allegheny or its authorized agent.
A. 
The owner or keeper of a licensed dog that has been seized and detained or observed by a Borough official due to running at large in violation of § 112-6 shall be cited for committing a violation of this article, payable by a penalty of $15 and a fine of $50, and costs, for the first offense. A penalty of $15 and a fine of $100 plus costs will be assessed for the second offense. A penalty of $15 and a fine of $200 plus costs will be assessed for the third and subsequent offenses.
B. 
If the dog has been seized and detained, the owner must claim the dog within five days after receiving notice that the Borough has detained the dog or the Borough will dispense the dog in accordance with 3 P.S. § 459-302(b).
C. 
Unlicensed dogs.
(1) 
The owner or keeper of any unlicensed dog that has been seized and detained or observed by a Borough official due to running at large in violation of § 112-6 shall be cited for committing a violation of this article, payable by a fine of $50 plus costs for the first offense, $100 plus costs for the second offense, and $200 plus costs for the third and subsequent offenses.
(2) 
In addition, said owner or keeper shall be cited for a summary offense under 3 P.S. § 459-201 and, upon conviction, shall be sentenced to pay a fine of not more than $300 for each unlicensed dog. If the dog has been seized and detained, the owner must claim the dog within two days or the Borough will dispense the dog in accordance with 3 P.S. § 459-302(c).
D. 
An owner or keeper whose dog is found to have bitten someone while running at large shall, upon conviction thereof, be sentenced to pay a fine of not more than $1,000 plus costs and, in default of payment of said fine and costs, to a term of imprisonment not to exceed 30 days which may be imposed following a hearing in accord with 42 Pa.C.S.A. § 9730. Such owner or keeper of said dog must also comply with 3 P.S. § 459-502 regarding the detention and isolation of any dog which bites or attacks a human being and, if the dog is deemed a dangerous dog in accordance with state law, must comply 3 P.S. § 459-502-A et seq.
E. 
Any person violating any other provision of this article shall, upon conviction thereof, be sentenced to pay a fine of not more than $1,000 plus costs and, in default of payment of said fine and costs, to a term of imprisonment not to exceed 30 days may be imposed following a hearing in accord with 42 Pa.C.S.A. § 9730. Each day that a violation of this article continues shall constitute a separate offense.
