A. 
There is hereby imposed a requirement for an annual license for each rental property. A fee required for the rental license shall be set by resolution of the Town Council and available in the Town office. The rental license fee shall be paid at the time the application is submitted.
B. 
Annually, the Town will send all property owners the application for rental license and a nonrental declaration form. Property owners must complete the rental license application or nonrental declaration form, under penalty of perjury, and return the same to Town Hall by the due date specified therein. Parking permits will not be issued until the Town receives a properly completed rental license application or nonrental declaration form.

C. 
No property owner shall lease or rent to another any residential or commercial property without first obtaining a valid annual rental license.
D. 
No property owner shall advertise to lease or rent to another any residential or commercial property without first obtaining a valid annual rental license.
E. 
Rental license applicants shall certify, under penalty of perjury, that all prior rental tax forms have been filed and that all rental tax and penalties due have been paid in full and that all information provided and statements made in the application are true and accurate.
F. 
Anyone having any delinquent tax, penalty, or other financial obligation due the Town shall be denied a rental license until the obligation is satisfied.

A. 
Any property owner found guilty of violating § 84-13C shall, upon a finding of violation by any court of competent jurisdiction, pay a civil penalty of $300 for each day of violation, plus court costs, and reasonable Town Attorney's fees.
B. 
Whenever any property owner shall have been notified in writing, certified mail, return receipt requested, by the Code Enforcement Constable or Town Manager or other Town official of violating § 84-13D, such property owner shall, upon a finding of violation by any court of competent jurisdiction, be subject to a civil penalty of $300 for each continued day of violation from the notification date, plus court costs, and reasonable Town Attorney's fees.
C. 
Any property owner charged with violating this article may cure the violation within 15 days by:
(1) 
Paying a voluntary assessment to the Town (in lieu of any civil penalty and going to court) in the amount of $150 per day of violation; and
(2) 
Completing all necessary action to demonstrate compliance with all provisions of this article. The payment of a voluntary assessment under this subsection shall constitute an administrative finding of guilt to the violation.
D. 
Use of the voluntary assessment may be utilized only once by the property owner. Any repeat violations subsequent to that utilization shall be subject to civil penalties as stipulated herein.
E. 
Any property owner electing to use the voluntary assessment procedure shall, prior to using such procedure, be notified of owner's rights and the associated procedures as required under § 4.2.28 of the Town Charter.
A. 
The Town Council may deny a renter's license or revoke a renter's license previously issued for the same reasons and in accordance with the same procedures as set out in § 84-10.1 of this chapter.
B. 
In the case of a rental license issued, such license may be revoked if there is reasonable evidence of two or more violations of Chapter 100, Peace and Good Order, during a calendar year. Oral and written notice of each such violation will be given to the licensed property owner and the owner's realtor (if applicable). Such license revocation may be immediate or deferred to the entire rental season for the following year or both. Prior to a license being revoked, the license holder shall be given notice and an opportunity to be heard pursuant to the procedures outlined in § 84-10.1. However, a license may be immediately revoked where the health, safety, and welfare of Town residents, property occupants, or other individuals are jeopardized. After revocations, the license holder shall be given notice and an opportunity to be heard pursuant to the procedures outlined in § 84-10.1.
