A. 
The Town Board of the Town of Milton is committed to the effective management of solid waste.
B. 
Saratoga County's enforcement of recycling and refuse has been accompanied by an unanticipated increase in littering and unlawful refuse disposal on public highways and adjoining public and private lands. This unfortunate situation impairs the health and safety of our citizens, diminishes the beauty and viability of our scenic lands and increases our fiscal burdens.
C. 
A Town-wide prohibition against littering and unlawful refuse disposal will complement our commitment to effective management solid waste and will supplement the statewide prohibition of such actions codified in Vehicle and Traffic Law § 1220. Effective management of solid waste mandates stricter penalties for littering and unlawful refuse disposal in the Town of Milton.
No person, firm, partnership, association, corporation, company or organization of any kind shall throw, deposit or place or cause to be thrown, deposited or placed upon any highway or within the limits of the right-of-way of such highway or upon private lands adjacent thereto any refuse, trash, garbage, rubbish, litter or any nauseous or offensive matter.
This article shall not apply on published pickup days by the Town of Milton.
Any person violating any of the provisions of this article shall be guilty of a violation punishable by minimum fine of $500 or community service not to exceed 60 hours or by both such fine and community service. The fine for a second violation of this article shall be $1,000 and any other subsequent violations shall be $1,000.
