The Hellam Township Roadmaster will notify 90 days in advance of any repair or restoration work, all utilities within the roadway designated for repair or restoration. Such notification shall be to allow utilities to perform any and all maintenance work which may be required prior to the roadway restoration.
A. 
Upon completion of the roadway repair or restoration by Hellam Township, a five-year moratorium for any new pavement cuts for those designated streets will be in effect. In the event of an emergency, any roadway cuts by a utility will require that the utility mill and overlay the entire lane of travel in the vicinity of the road cut, thirty-foot minimum in each direction from the work area. If such cuts involve both lanes of travel, the milling and overlay will extend the entire cartway width in the vicinity of the road cut, 30 feet minimum in each direction from the work area.
B. 
All permits for road cuts are issued at the discretion of the Township.
Any person who violates or permits a violation of this article shall, upon conviction in a summary proceeding brought before a Magisterial District Judge under the Pennsylvania Rules of Criminal Procedure, be guilty of a summary offense and shall be punishable by a fine of not more than $1,000, plus all costs of prosecution, including, but not limited to, attorneys' fees, and in default of payment thereof, shall be imprisoned for a term not to exceed 90 days. Each day or portion thereof that such violation continues or is permitted to continue shall constitute a separate offense, and each section of this article that is violated shall also constitute a separate offense.
