No person shall encumber or obstruct any street or public place within the Borough with any article or thing whatsoever unless he or she has obtained a permit to do so approved by the Council and signed by the Borough Clerk.
A. 
Application for a permit required by § 260-21 shall be made to the Borough Clerk, in writing, except as otherwise provided in § 260-23, and shall specify:
(1) 
The full name and address of the person to whom the permit is to be granted.
(2) 
The place or places at which the work is to be done.
(3) 
The character of the work and purpose of the permit.
(4) 
The length of time for which the permit is requested.
(5) 
Such additional information as the Borough Engineer may require.
B. 
The fee as prescribed by § 260-5 shall accompany each application.
C. 
The person or persons responsible for obstructing the street shall obtain liability insurance for a minimum of $1,000,000, naming the Borough of Hillsdale as additional insured and shall contain a hold-harmless clause in favor of the Borough of Hillsdale.[1]

The Borough Clerk is hereby authorized to grant permission on request to carpenters, masons, builders, contractors, homeowners or materialmen to use 1/3 of the street in front of any premises upon which it is intended to construct, alter or repair any building or store, building material and equipment, for a period not exceeding 10 days upon payment of the fee referred to in § 260-22 and upon the conditions that the applicant will remove all surplus material and refuse from the street when the work is completed, will not obstruct the free flow of water in the said street and will guard the said obstruction with lights and otherwise at night.

The issuance of a permit pursuant to the provisions of § 260-21 shall impose upon the permittee the responsibility to:
A. 
Remove all surplus material and refuse from the street upon completion of the project or expiration of the permit.
B. 
Guard the obstruction with adequate safeguards, including lights at night.
C. 
Not to obstruct the free flow of water in the street.
Access to and across sidewalks and curbs shall be left open and suitable planks provided for the safety of pedestrians at all times.
Any person who violates any provision of this article shall, upon conviction thereof, be subject to the provisions of Chapter 226, Penalties.
