The Village of Hamburg adopts as its rules and regulations for use of the sanitary sewers within the Village of Hamburg the Erie County Department of Environment and Planning Division of Sewerage Management Rules and Regulations for Erie County Sewer Districts as amended from time to time.
The rules and regulations for use of village sanitary sewers shall include the specifications for subdivisions and sanitary sewer extensions and design requirements for subdivisions and sanitary sewer extensions as adopted by the Erie County Department of Environment and Planning Division of Sewerage Management as amended from time to time.
The administration and enforcement of these regulations shall be provided by the Superintendent of Public Works or his designee. The term "district" used in the rules and regulations shall mean the Village of Hamburg. The term "Board" as used in the rules and regulations shall mean the Board of Trustees of the Village of Hamburg.
The Superintendent of Public Works and other duly authorized employees of the village bearing proper credentials and identification shall be permitted to enter all private properties through which the village holds a duly negotiated easement for the purposes of, but not limited to, inspection, observation, measurement, sampling, repair and maintenance of any portion of the sewage works lying within said easement. All entry and subsequent work, if any, on said easement shall be done in full accordance with the terms of the duly negotiated easement pertaining to the private property involved.
It shall be unlawful for any person to place, deposit or permit to be deposited in any unsanitary manner on public or private property within the village or in any area under the jurisdiction of the village any human or animal excrement, garbage or other objectionable waste.
The owners of all houses, buildings or properties used for human occupancy, employment, recreation or other purposes situated within the village, and abutting on any street, alley or right-of-way in which there is now located or may in the future be located a public sanitary or combined sewer of the village, are hereby required at their expense to install suitable toilet facilities therein and to connect such facilities directly with the proper public sewer in accordance with the provisions of this article within 90 days after date of official notice to do so, provided that said public sewer is within 100 feet (30.5 meters) of the property line.
No unauthorized person shall maliciously, willfully or negligently break, damage, destroy, uncover, deface or tamper with any structure, appurtenance or equipment which is a part of the sewage works. Any person violating this provision shall be subject to immediate arrest under the appropriate provisions of the Penal Law of the State of New York.
A. 
Any person found to be violating any provision of this article, except § 186-14, shall be served by the village with written notice stating the nature of the violation and providing a reasonable time limit for the satisfactory correction thereof. The offender shall, within the period of time stated in such notice, permanently cease all violations.
B. 
Any person who shall continue any violation beyond the limit of time provided for in Subsection A shall be guilty of a violation and, upon conviction thereof, shall be punishable by a maximum fine of $250 or by a term of imprisonment of not more than 15 days, or both.
C. 
Any person violating any of the provisions of this article shall become liable to the village for any expense, loss or damage occasioned the village by reason of such violation.
