The Cold Spring Road Sanitary Sewer District, hereafter called the District, is hereby established for the purpose of securing the health and safety of the inhabitants from the dangers of disease, pollution and contamination of the soil and water through the provision of sanitary sewer services. Its further purpose shall be to provide for an ordered development process within the District, relating development to be served by the sewer to the intent and design capacity of the sewer; and to provide for fiscal stability through the planned and orderly use of community services which have limited capacity to support additional growth and development.
A. 
The District shall consist of all properties abutting on Cold Spring Road lying between the origin of the sewer at Mt. Greylock High School and its terminus at Bee Hill Road. Properties on both sides of the road shall be included.
B. 
In cases in which new lots are created through legal subdivision of land, only those lots actually abutting on Cold Spring Road so created shall be deemed as being within the District. Properties in the vicinity of the District but not served by the District shall be unaffected by its creation, having no special fees nor requirements and remaining subject to the normal requirements of on-site disposal of sanitary wastes. Owners of premises located within the District must dispose of their sanitary wastes via the Cold Spring Road sanitary sewer subject to all special and general provisions contained within these rules and regulations unless specifically exempted in writing by the Health Inspector for reasons of excessive distance from the sewer or other hardship or community benefit. The reasons for such exemption shall be included in the written exemption provided by the Health Inspector.
Only these properties within the District shall be granted a permit to make connection to the Cold Spring Road sanitary sewer. A separate and independent building sewer shall be provided for every building, except as may be approved by the Sewer Commission.
Special restrictions and requirements shall be applicable to the District as follows:
A. 
Any sewage discharged into this sewer shall be required to have preliminary treatment by one of the following means:
(1) 
Removal of solids in a septic tank of approved size for the amount of sewage to be discharged.
(2) 
Reduction of size of sewage solids by means of a grinder pump facility.
B. 
At locations where the sanitary sewer is a pressure grinder pump, installation with a pressure discharge shall be required.
C. 
Owners requiring a simplex or duplex grinder pump installation shall purchase the pump station from the Town of Williamstown at the town's cost.
D. 
The owner of any premises served by the Cold Spring Road sanitary sewer shall grant the Town of Williamstown an easement for sewer service maintenance.
E. 
All connections to the sanitary sewer shall be submitted to the Superintendent for approval and shall carry the seal of a registered professional engineer.
F. 
An as-built plan sealed by a registered professional engineer shall be provided to the Superintendent.
G. 
All premises where septic tanks are used for pretreatment shall have their septic tanks pumped at a frequency established by the Superintendent. The owner of the premises shall notify the Superintendent by regular mail when septic tanks are cleaned.
H. 
All premises where grinder pumps are used for pretreatment shall maintain normal, commercially available electrical power to their grinder pump station at all times and shall pay the cost of required electric power usage.
I. 
The owner or occupant of any premises served by a grinder pump station shall report any failure or malfunction of such station immediately to the Superintendent.
Owners of premises served by the Cold Spring Road sanitary sewer shall be liable for a sewer surcharge as approved by the Board of Selectmen.
