It is the intent of this chapter to eliminate alcohol abuse among minors within the Village of Maybrook, promote public tranquility and promote the safety, health and well-being of minors within the village pursuant to powers granted to the village under Article IX, Section 2(C)(10) of the New York State Constitution.
The following words and terms below shall have the meanings as indicated:
ALCOHOLIC BEVERAGE
Any alcohol, spirits, liquor, wine, beer, cider and every liquid or solid, patented or not, containing alcohol, spirits, liquor, wine or beer and capable of being consumed by a human being.
MINOR
Any person who, because of age, cannot legally drink an alcoholic beverage in New York State pursuant to Alcoholic Beverage Control Law § 65.
It shall be unlawful for any minor to possess an alcoholic beverage within the village.
A police officer shall confiscate all alcoholic beverages possessed by a minor in violation of this chapter.
Violations of this chapter shall be punishable by fines of up to $250.
