Zoning  — See Ch. 210.
Unless an action is otherwise a Type I action under Section 617.4 of the SEQRA Regulations, the following actions shall not be subject to review under SEQRA in such instances where the Village of Maybrook, its Board of Trustees, Planning Board or Zoning Board of Appeals acts as the lead agency or an involved agency:
A. 
Within the TDD Overlay District and subject to site plan review, construction or expansion of a structure or facility involving less than 8,000 square feet of total gross floor area and/or no more than 10 residential units where the project will be connected to Village water and sewer, where the project fully complies with zoning without requiring any variances, and where a Phase 1 Environmental Site Assessment has been performed and any identified recognized environmental condition(s) have been abated or otherwise satisfied in conformance with all relevant regulatory requirements.
