The Board of Supervisors of the Township of Bethel, Delaware County, Pennsylvania, constituting the "Municipal Authority" of said Township as defined in the Municipal Authorities Act of 1945 (the Act of May 2, 1945, P.L. 382, as amended and supplemented)[1], hereby signifies its intention to organize an Authority under the provisions of said Act.

The name of the proposed Authority is "Bethel Township, Delaware County, Sewer Authority". In pursuance of said intention, the Articles of Incorporation of the said Authority hereby are approved and adopted in the following form:
ARTICLES OF INCORPORATION
BETHEL TOWNSHIP, DELAWARE COUNTY, SEWER AUTHORITY
TO THE SECRETARY OF THE COMMONWEALTH OF PENNSYLVANIA:
In compliance with the Municipality Authorities Act of 1945 (the Act of May 2, 1945, P.L. 382, as amended and supplemented) the Township of Bethel, Delaware County, Pennsylvania, pursuant to an ordinance duly enacted by the Board of Supervisors of said Township authorizing and directing the formation of an Authority under said Act, DOES HEREBY CERTIFY:
(a)
The name of the Authority shall be "Bethel Township, Delaware County, Sewer Authority."
(b)
The said Authority is formed under the Municipality Authorities Act of 1945.
(c)
No other Authority has been organized under the Municipality Authorities Act of 1945 or under the Act approved June 28, 1935, P.L. 463 or is in existence in and for said Township of Bethel.
(d)
The name of the incorporating municipality is the Township of Bethel, Delaware County, Pennsylvania; the names and addresses of its municipal authorities are as follows:

The terms of office of the first members of the Board of said Authority shall commence on the date of appointment and shall be computed from the first day of January 1974.
(f)
The said Authority is organized for the purpose only to acquire, hold, construct, improve, maintain, operate, own and lease, either in the capacity of lessor or lessee, sewers, sewer systems or parts thereof, sewerage treatment works, including works for treating and disposing of industrial waste, in and for the Township of Bethel, and such other territory as it may be authorized to serve, and shall exercise all of the powers granted to an Authority organized for such purpose by the Municipality Authorities Act of 1945 under which it is organized.
(g)
The term of existence of said Bethel Township, Delaware County, Sewer Authority shall be for a period ending on March 15, 2045.

IN WITNESS WHEREOF, the Township of Bethel, Delaware County, Pennsylvania, has caused these Articles of Incorporation to be duly executed on behalf of said Township of Bethel, Delaware County, Pennsylvania, by its proper officers hereunto duly authorized and under its municipal seal this 18th day of September 1973.

On this _____ day of _______________, 1973, before me a Notary Public in and for the said Commonwealth, personally appeared the above named Fred S. Suloff, Vernon E. Booth and Robert Miller, whose official positions in the Township of Bethel, Delaware County, Pennsylvania, are respectively Chairman and members of the Board of Supervisors of said Township, and Constance Meli, the Secretary of said Township, who, in due form of law, acknowledged the foregoing Articles of Incorporation to be the act and deed of the Township of Bethel, Delaware County, Pennsylvania, for the purposes therein specified.

The first members of the Board of the Township of Bethel, Delaware County, Sewer Authority, named in the aforesaid Articles of Incorporation, hereby are specifically appointed members of said Board for the terms of office set after their respective names, which terms shall commence on the date of appointment and shall be computed from the first day of January 1974.
Bethel Township, Delaware County, Sewer Authority shall be organized for the purpose only to acquire, hold, construct, improve, maintain, operate, own and lease, either in the capacity of lessor, lessee, sewers, sewer systems or parts thereof, sewerage treatment works, including works for the treating and disposing of industrial waste, in and for the Township of Bethel, Delaware County, and such other territory as it may be authorized to serve, and shall exercise all of the powers granted to an authority organized for such purpose by the Municipality Authorities Act of 1945 under which it is organized.
The proper officers of the Township of Bethel, Delaware County, hereby are authorized and directed to execute said Articles of Incorporation on behalf of said Township, and the Secretary is authorized and directed to affix thereto the seal of the Township and to attest the same, cause a notice of intention to file said Articles of Incorporation to be published as required by law, and to file said Articles of Incorporation, together with a certified copy of this ordinance[1] and required proofs of publication, with the Secretary of the Commonwealth of Pennsylvania, and to do, execute and perform any and all acts and things necessary or appropriate to effect and establish said Bethel Township, Delaware County, Sewer Authority.
