The office of Borough Manager (“Manager”) is hereby created for the Borough of Crafton. For purposes of this Code, “Manager” shall be defined as the Manager of the Borough of Crafton, his authorized designee and/or the authorized designee of Borough Council.
The Borough Council (“Council”) shall appoint a Manager for an indefinite term. The Manager shall serve at the pleasure of Council and may be removed from the position at any time by a majority vote of all Council members then in office. At least 30 days before such removal is to become effective, Council shall furnish the Manager with a written statement setting forth its intention to remove the Manager.

The Manager shall be chosen solely on the basis of executive and administrative abilities and qualifications, with special reference to the duties of the office as herein outlined. The Manager need not be a resident of the Borough. The Manager shall reside within a distance of the Borough that allows for the Manager's availability at the Borough offices within a reasonable amount of time to adequately address the immediacy of an emergency issue or nonemergency, time-sensitive issue of high priority.

Before taking office, and each year thereafter, the Borough Manager shall furnish a fidelity bond[1] in an amount set from time to time by resolution of the Borough Council, conditioned upon the faithful performance of his/her duties. This fidelity bond shall be in a form acceptable to the Borough Solicitor and shall be issued by a corporation licensed to do business as a surety in the Commonwealth of Pennsylvania. The cost of such bond shall be paid from the general revenue of the Borough.

The compensation and other benefits of the Borough Manager shall be fixed from time to time by Council.
A. 
The Manager shall be the chief administrative officer of the Borough and shall be responsible to Council as a whole for the proper and efficient administration of the affairs of the Borough. The powers and duties of administration of all Borough business shall be vested in the Manager, unless expressly imposed or conferred by statute or ordinance upon other Borough officers.
B. 
The Manager shall have the following powers and duties:
(1) 
To supervise and be responsible for the activities of all municipal departments, except as otherwise provided by law.
(2) 
To hire, suspend or discharge any employee under the Manager’s supervision, provided that any person covered by the civil service provisions of the Borough Code[1] shall be hired, suspended or discharged in accordance with such provisions, and provided further that the Manager shall report, at the next meeting thereafter of Council, any action taken by authority of this subsection.

(3) 
To fix wages and salaries of all personnel under the Manager’s supervision, within a range previously determined by Council.
(4) 
To attend all Borough Council meetings and to have the right to take part in discussions, but not to vote, and, at the request of any Council committee chair, to attend any Council committee meetings. The Manager shall receive notice of all special meetings of Council and its committees.
(5) 
To prepare the agenda for each meeting of Council and supply pertinent facts for each agenda item.
(6) 
To prepare and submit to Council before the close of each fiscal year a budget for the next fiscal year and an explanatory budget message. In preparing the budget, the Manager, or an officer designated by the Manager, shall obtain from the head of each department, agency or board, or any qualified officer thereof, and from the chair of each committee of Council, estimates of revenues and expenditures and such other supporting data as is required. The Manager shall review such estimates and may revise them before submitting the budget to Council.
(7) 
To be responsible for the administration of the budget after its adoption by Council.
(8) 
To submit to Council, as soon as possible after the close of the fiscal year, a complete report on the finances and the administrative activities of the Borough for the preceding year.
(9) 
To develop, in conjunction with the preparation of the yearly budget, long-range fiscal plans for the Borough, such plans to be presented annually to the Council for its review and adoption.
(10) 
To keep Council informed as to the conduct of Borough affairs; to submit periodic reports on the condition of Borough finances and such other reports as Council requests; and to make recommendations to Council as the Manager deems advisable.
(11) 
To hold such other Borough offices and to head such Borough departments as Council may from time to time direct.
(12) 
To see that the provisions of all franchises, leases, permits and privileges granted by the Borough are observed.
(13) 
To employ, with approval of Council, experts and consultants to perform work and to advise the Manager in connection with any of the functions of the Borough.
(14) 
To attend to the letting of contracts in due form of law and to supervise the performance and faithful execution of the same, except insofar as such duties are expressly imposed by statute upon another Borough officer.
(15) 
To see that all money owed the Borough is promptly paid and that proper proceedings are taken for the security and collection of all the Borough’s claims.
(16) 
To serve as purchasing officer of the Borough or to designate an administrative staff member to purchase, in accordance with the provisions of the Borough Code,[2] all supplies and equipment for the agencies, boards, departments and other offices of the Borough. The Manager shall keep an account of all purchases and shall, from time to time or when directed by Council, make a full written report thereof. The Manager shall also issue rules and regulations, subject to the approval of Council, governing the procurement of all municipal supplies and equipment.

(17) 
To investigate and dispose of all complaints regarding Borough services under the Manager’s supervision, and to report to Council thereon.
(18) 
To enforce the ordinances and regulations of the Borough.
(19) 
To cooperate with Borough Council at all times and in all matters so that the best interests of the Borough and of the general public may be maintained.
If the Manager becomes ill or needs to be absent from the Borough, the Manager shall designate one qualified member of the Manager’s staff to perform the duties of the Manager during the Manager’s absence or disability. The person so designated shall not perform these duties for a period longer than two weeks without approval of Council.

As used in this article, the following terms shall have the meanings indicated:
INDEPENDENT AUDITOR
The person or persons appointed by Council pursuant to and with powers and duties as specified in the Borough Code, 53 P.S. § 45101 et seq., as amended.[1]

A. 
Council shall annually appoint by resolution, by December 31 of each year, an independent auditor to make an independent examination of the accounting records of the Borough of Crafton for that fiscal year.
B. 
The independent auditor shall perform such other duties and have such powers as specified in the Borough Code, 53 P.S. § 45101 et seq., as amended.[1]

A. 
As of December 12, 2001, the office of elected Borough auditor is hereby abolished.[1]

B. 
The elected Borough auditors holding office at the time of the abolition of said office shall continue to hold their office during the term for which elected.
C. 
The elected Borough auditors shall not audit, settle or adjust the accounts audited by the independent auditor.
D. 
The elected Borough auditors shall perform the other duties of their office until the expiration of their term.
