A. 
There is hereby established in the Borough of Teterboro a State Uniform Construction Code Enforcing Agency, to be known as the "State Uniform Construction Code Enforcing Agency of the Borough of Teterboro," consisting of a Construction Official, Building Subcode Official, Plumbing Subcode Official, Electrical Subcode Official, Fire Protection Subcode Official and Elevator Subcode Official. The Construction Official shall be the chief administrator of the Enforcing Agency.

B. 
Each official position created in Subsection A hereof shall be filled by a person qualified for such position pursuant to P.L. 1975, c. 217,[1] as amended, and N.J.A.C. 5:23, provided that, in lieu of any particular subcode official, an on-site inspection agency may be retained by contract pursuant to N.J.A.C. 5:23. More than one such official position may be held by the same person, provided that such person is qualified pursuant to P.L. 1975, c. 217, as amended, and N.J.A.C. 5:23 to hold each such position.

C. 
The public shall have the right to do business with the Enforcing Agency at one central permit office located in the Municipal Building except for emergencies and unforeseen circumstances.

Pursuant to the provisions of P.L. 1975, c. 217, as amended (N.J.S.A. 52:27D-127), and N.J.A.C. 5:23, all appeals from decisions of the Enforcing Agency of the Borough of Teterboro shall be subject to the jurisdiction of the Construction Board of Appeals to the County of Bergen.
A. 
Agency designation. The local enforcing agency for elevator subcode inspections shall be Building Inspection Underwriters, Inc., located at 1451 Route 46 West, Room 206, Ledgewood, New Jersey.
B. 
Duties. The local enforcing agency provided for in this section shall enforce the provisions of the Uniform Elevator Subcode within the established boundaries of the Borough of Teterboro.
C. 
Organization. The local enforcing agency established by this section shall be a part of the Teterboro Uniform Construction Code Enforcing Agency and shall be under the direct supervision and control of the Construction Code Official.
D. 
Term of appointment and removal.
(1) 
Appointment of Elevator Subcode Official. The local enforcing agency shall be under direct supervision of the Construction Code Official and shall be appointed by the Mayor and Council of the Borough of Teterboro with the advice and consent of the Construction Code Official.
(2) 
Term of appointment. The Elevator Subcode Official shall serve the borough for a term of one year; any vacancy shall be filled for the unexpired term.
(3) 
Removal. The Enforcing Agency shall be subject to removal by the Construction Code Official for inefficiency or misconduct.

A. 
The revised Fee Schedule and Standards for the Borough of Teterboro Construction Department, including but not limited to plan review, construction permit, certificate of occupancy, certificate of continued occupancy, certificate of approval, demolition permit, plumbing permit, electrical permit, elevator permit and sign permit, are hereby established as set forth in Schedule A,[1] annexed hereto and made a part hereof, and is intended to become effective on the date of adoption by the governing body of the Borough and any required publication as permitted by law.

B. 
The Construction Official shall, with the advice of the subcode officials, prepare and submit to the Borough Council, biannually, a report recommending a fee schedule based on the operating expenses of the Agency and any other expenses of the municipality fairly attributable to the enforcement of the State Uniform Construction Code Act.[2]

C. 
In order to provide for the training, certification and technical support programs required by the Uniform Construction Code Act and the regulations, the Enforcing Agency shall collect, in addition to the fees specified above, surcharge fees, which shall be charged, collected and submitted as required by the regulations (N.J.A.C. 5:23-4.19 et seq.).[3]
