[Adopted by Ord. No. 93-200 (Sec. 15-3 of the 1996 Revised General Ordinances)]
There is hereby established in the Township of Manchester an ordinance to define and establish fire zones as follows.
This article may be cited as the "Fire Zone Ordinance of the Township of Manchester." The provisions of N.J.S.A. 39:1-1 et seq., not inconsistent herewith or otherwise more specifically defined, are hereby adopted by reference.
The residents of the Township of Manchester have a right to, and should be ensured that certain public areas referred to herein have unobstructed means of ingress and egress to property and buildings in the event of a fire or other emergency.

A. 
Upon a finding that such action is necessary for the public safety, the Fire Marshal may require the owner or owners of any shopping center, commercial structure, place of public assembly, multiple dwelling group, industrial park, office building, hotel or motel, school, or any other privately owned premises upon which the public shall be invited, to designate "Fire Zone" in the driveways of the premises leading to and from the parking areas, loading areas, public streets or rights-of-way leading to the above type building or structures.

Such fire zones, also to be known as "fire lanes," shall be no less than 10 feet or more than 50 feet in width and shall be striped and lettered in yellow on a paved surface, such striping and lettering to remain legible at all times. Metal "Fire Zone" signs, the lettering or same to be legible at all times, shall be provided, erected and maintained by the owner or owners and placed at the discretion of the Fire Marshal. The signs are to be of design and quality and lettered in accordance with applicable state law and approved by the Fire Marshal and shall be in accordance with Drawing No. 1 attached hereto.[1]

(2) 
The Fire Marshal may recommend to the Township Council fire zones for public land or publicly owned structures or premises as fire zones in the interest of public safety.
B. 
No person shall, at any time, park a vehicle, or in any other manner, obstruct any driveway or other area that has been designated as hereinabove provided as a "Fire Zone."

A. 
Fire zones shall be established in all shopping centers to ensure fire equipment and other emergency vehicles unobstructed means of ingress and egress to properties and buildings located therein in the event of a fire or other emergency.
B. 
The number, location, dimensions and markings of such areas shall be determined by the Fire Marshal based upon the size, type and location of the buildings in such shopping centers; the type of uses contained therein, the number of motor vehicles operated and parked upon the property, the number of persons using and occupying the premises, the existing means of ingress and egress, the total area of property and other relevant factors.
C. 
The Fire Marshal is authorized to regulate, restrict and prohibit the parking and operation of motor vehicles in and near such fire areas, and to impose other reasonable regulations necessary to ensure that such areas are free from obstructions.

The Fire Marshal and the Police Department of the Township of Manchester shall have concurrent jurisdiction to enforce the provisions of this article.
A. 
Any violation of the provisions of this article shall be punishable by a fine of not more than $2,000, by imprisonment for not more than 90 days, or by community service for up to 90 days, or any combination thereof.[1]

B. 
Notwithstanding the penalties hereinabove provided for violations of this article, the Township shall be entitled to pursue any other remedy available at law or equity to enforce the provisions hereof.
