The purpose of this chapter is to control garage sales, lawn sales, rummage sales, flea market sales or other casual sales. Restrictions are established as to allowable days of operation and advertising signs. Certain persons and sales are exempt from the requirements.
As used in this chapter, the following terms shall have the meanings indicated:
GARAGE SALES
Includes all sales commonly known as "garage sale," "lawn sale," "rummage sale," "yard sale," "flea market sale" or any similar casual sale, noncommercial, by private persons of tangible personal property which is advertised by any means whereby the public at large is or may be made aware of said sale.
GOODS
Includes any goods, warehouse merchandise or other property capable of being the object of a sale regulated hereunder.
PERSON
Includes individuals, voluntary associations, partnerships and corporations and voluntary not for profit associations, partnerships and corporations.
A. 
Garage sales shall be prohibited Monday through Thursday except for the following Monday holidays: Martin Luther King Day, Presidents' Day, Memorial Day and Labor Day.
B. 
All garage sales shall be conducted between the hours of 9:00 a.m. and 6:00 p.m.
A. 
Signs posted on handbills advertising a garage sale as herein defined shall be of a size not larger than 12 inches by 12 inches and must contain, in addition to the definition of the type of sale being advertised, the name and address of the person conducting the sale.
B. 
All such signs shall be removed within 48 hours after the completion of the sale. A newspaper advertisement of such sale shall contain the address of the person conducting the sale.
C. 
Signs advertising permitted yard sales shall not be posted on telephone poles, other public utility structures or within any required sight triangle.
Any bona fide charitable, philanthropic, educational, cultural or other organization or association not for profit may be exempted from the weekend and holiday limitation fixed by this chapter upon demonstrating to the Township Attorney its right to such exemption. The production of a certificate of incorporation pursuant to Title 15 of the Revised Statutes of New Jersey shall be presumptive evidence of the right of such organization to this exemption.
