A certain document, three copies of which are on file in the office of the Township Clerk of the Township of Manchester, being marked and designated as "The International Property Maintenance Code, 2018 Edition," as published by the International Code Council, be and is hereby adopted as the Property Maintenance Code of the Township of Manchester, in the State of New Jersey; for the control of buildings and structures as herein provided; and each and all of the regulations, provisions, penalties, conditions and terms of said Property Maintenance Code are hereby referred to, adopted, and made a part hereof, as if fully set out in this article, with the additions, insertions, deletions and changes to the IPMC, 2018 Edition, prescribed in § 313-2 of this article. Additional codes to be referenced shall be the New Jersey Uniform Construction Code and the New Jersey Uniform Fire Code adopted by the New Jersey State Legislature.

Nothing in this article or in the Property Maintenance Code hereby adopted shall be construed to affect any suit or proceeding in any court, or any rights acquired, or liability incurred, or any cause or causes of action acquired or existing, under any act or ordinance hereby repealed as cited in this article; nor shall any just or legal right or remedy of any character be lost, impaired or affected by this article.

If an owner or agent fails to comply with an order to repair or improve a structure or to demolish same if required by an order of removal or fails to rectify conditions existing on land, either vacant or occupied, that constitute a violation of this article within the time period set forth in an order issued by the Construction Official, then the Construction Official may cause such building to be repaired, improved or demolished or cause such conditions existing on land to be corrected by the Township and certify the cost thereof to the Township Council, which, after examination of the certificate and determination of its accuracy, shall cause the cost thereon to be charged against the lot or land on which the violation exists. The amount so charged shall become a lien upon such lot or land and shall be added to and become and form part of the taxes next to be assessed and levied upon such lot or land, the same to bear interest at the same rate as taxes, and to be collected and enforced by the same officers responsible for the collection of taxes and in the same manner as taxes.
