As used in this article, the following term shall have the following
meaning:
SMOKING
The burning of lighted cigar, cigarette, pipe or any other
matter or substance which contains tobacco.
The Township, in accordance with N.J.S.A. 40:48-1 deems it in
the public interest to prohibit smoking in public school buildings
located within the Township except as part of classroom instruction
or theatrical production. In addition, smoking shall be prohibited
on the school grounds consistent with the regulations promulgated
by the school administration.
Any school board having a public school building located within
the Township shall make and enforce regulations to prohibit the smoking
of tobacco anywhere in the buildings except as part of classroom instruction
or theatrical production. The regulation shall also offer additional
specified limitations of any smoking on school grounds as designated
by the school administration.
The superintendent or his/her designee of the school district
may sign a complaint against any individual for violations of the
provisions of this article.
Every public entrance to school shall be posted, by the person
who has control of the building, with a sign indicating that smoking
is prohibited in the building. The sign may also indicate that violators
are subject to a fine. Every sign required by this article shall be
located so as to be clearly visible to the public and shall contain
letters or symbol which contrast in color to the sign.
Any person who smokes in violation of this article except as
part of a classroom instruction, or theatrical production shall be
subject to fine not to exceed $100 or by community service, not to
exceed three days or any combination of fine and community service
as determined in the discretion of a municipal court judge.
