The Commissioner of Public Works, or other Village official
duly designated by the Village Board, subject to approval of the Village
Board by resolution, is authorized to make, adopt and publish such
rules and regulations as may be necessary for the administration and
enforcement of the provisions of this chapter; provided, however,
that such rules and regulations shall not be in conflict with the
provisions of this chapter and shall be subject to the approval of
the Village Board.
It shall be the duty of the Commissioner of Public Works, or
his duly appointed agent, and/or the Code Enforcement Officer of the
Village of West Haverstraw, to enforce the provisions of this chapter.
A.
It shall
be unlawful for any person to violate any provision of this chapter
or any implementing rule or regulation promulgated or established
hereunder.
B.
Any person
who shall violate any provision of this chapter or any rule or regulation
promulgated or established thereunder shall be guilty of a violation
punishable as follows:
(1)
For
a first conviction: by a fine of not less than $ 150 nor more than
$350.
(2)
For
a second conviction: by a fine of not less than $350 nor more than
$700.
(3)
For
a third or subsequent conviction: by a fine of not less than $700
nor more than $1,000 and/or by a period of imprisonment of up to 90
days.
C.
Each day
any such violation shall continue unabated shall constitute a separate
offense.
D.
Nothing
contained in this section shall prevent the Village from pursuing
any other legal or equitable remedy otherwise available to it by law.
