A. 
Removal; collection of fee.
(1) 
Any vehicle parked or standing within the Village of Nyack, known by the Village to have delinquent Village parking tickets, may either:

(a) 
Be towed by the Village to a designated lot or yard; and/or
(b) 
Have a boot attached to the vehicle's wheel(s).
(2) 
Before releasing a towed or booted vehicle to the registered operator, the Village shall receive from the operator the fee set forth below as well as the fines and penalties due for delinquent parking tickets previously issued in the Village to said vehicle. The operator must also supply proof of ownership of said vehicle and of current auto insurance to the Clerk of the Village's Parking Violation Bureau. Upon receipt of all of the foregoing, the operator will receive a receipt authorizing the operator to pick up the towed vehicle and/or to have any boot removed. This fee shall be in addition to any fine that may otherwise apply under this chapter to said parking violation.
B. 
Determination of fee; type of payment.
(1) 
The fees payable to the Village before the removed or booted vehicle will be released to the lawful operator will be set each year by resolution of the Board of Trustees based upon publicly bid contract for such services. The fees will vary for:
(a) 
A towed car, even if booted at the yard;
(b) 
A towed truck or van, even if booted at the yard; and
(c) 
A booted vehicle that has not been towed.
(2) 
The fee schedule will also include a daily storage rate. Payments of these fees and delinquent fines shall be in cash, certified check, bank check or money order.
C. 
If the vehicle was towed or disabled because it was illegally parked and standing and it is determined by the Village Justice Court that the vehicle was not illegally parked or standing, the Village shall refund the fee paid under Subsection B above for the release of the vehicle within 15 days of such determination by the Village Justice.

Any vehicle found in an area temporarily posted by the Village of Nyack or the Orangetown Police Department as being a no-parking zone due to a parade, street fair or other special event authorized by the Board of Trustees shall be subject to towing pursuant to the provisions of § 330-67 if:
A. 
The notice prohibiting parking is prominently posted, in view of the affected parking area;
B. 
The notice indicates when parking is prohibited, showing both the date and time period affected; and
C. 
The notice is posted at least 24 hours before the no-parking period begins.
