In case any building or structure is erected, constructed, altered,
repaired, converted or maintained or any building, structure or land
is used in violation of this chapter or any other ordinance or other
regulation made under authority conferred hereby, the proper local
authorities of the municipality or an interested party in addition
to other remedies, may institute any appropriate action or proceedings
to prevent such unlawful erection, construction, reconstruction, alteration,
repair, conversion, maintenance, or use; to restrain, correct or abate
such violation; to prevent the occupancy of said building, structure
or land; or to prevent any illegal act, conduct, business or use in
or about such premises.
Violation of the provisions of this chapter or failure to comply
with any of requirements, to include violations of conditions and
safeguards established in connection with grants of site plan, conditional
use, or use variance approvals shall constitute a misdemeanor.
Any person, firm, corporation partnership or other business
association found guilty of violating any of the provisions of this
chapter shall be subject to a fine of not more than $500 for each
offense and/or confinement in the Ocean County jail for a period of
not more than 30 days. In the case of a continuing violation or violations,
a fine of not more than $500 may be assessed for each day that said
violation or violations continue unabated until such time as same
are corrected.
