There is hereby established an Affirmative Action Review Council of the City of Camden, with the powers and duties hereinafter provided.

A. 
The Affirmative Action Review Council ("Council") shall consist of seven members. Initially, and thereafter in instances where the Council's membership is to be reconstituted in its entirety, the composition of the Council shall consist of four members who shall be appointed for terms of two years and three members who shall be appointed for periods of one year; thereafter, all members of the Council shall be appointed for terms of two years.
B. 
The Mayor and City Council shall each appoint two of the initial two-year term members provided in § 14-3A above.
C. 
The Mayor shall appoint one and City Council shall appoint two of the initial one-year term members provided in § 14-3A above.

A. 
Three members of the Affirmative Action Review Council shall be appointed by the Mayor and four of the Council's members shall be appointed by City Council.
B. 
The Mayor and City Council shall make every effort to include, as members of the Affirmative Action Review Council, representation from minority-owned businesses; organized labor; developers, contractors, and/or subcontractors' associations; and City government.
C. 
The Mayor and the City Council shall appoint individuals to the Affirmative Action Review Council who are committed to the letter and spirit of this chapter and the purpose and principles which it seeks to advance.

Members of the Affirmative Action Review Council may be removed for nonperformance or neglect of duties or for other good cause by the Mayor, with the concurrence of the majority of City Council.
Members of the Affirmative Action Review Council shall serve without compensation.
Vacancies in the Affirmative Action Review Council, for whatever reason, shall be filled in the manner herein provided for new appointments.
The powers and duties of the Affirmative Action Review Council shall include the following:
A. 
Adopting rules and procedures for the regulation and conduct of its meetings.
B. 
Evaluating the initial work force report and other relevant information submitted by the developer/contractor who is the apparent low bidder and the known principal subcontractors in order to determine the adequacy of the developer/contractor's plan to attain the hiring goals established in § 14-10 and the minority business enterprise goals established in § 14-13.
C. 
Making recommendations to the Camden City Council regarding the award of contracts that are subject to the provisions of this chapter.
D. 
Reviewing any contracts awarded that are subject to the goals enumerated in § 14-14 and making recommendations to the Department of Administration and Finance and, where appropriate, to the Camden City Council.

E. 
Monitoring and enforcing the affirmative action performance of contractors subject to the provisions of this chapter.
F. 
Supplying information to all minority organizations who request information regarding minority participation in proposed projects.
G. 
Establishing and improving formats for reports, schedules and such other documentation that may be reasonably required to implement this chapter.
H. 
Evaluating and approving training programs pursuant to the provisions of § 14-10A(2) and B.

In addition to any other powers and duties that may be assigned to the Affirmative Action Officer by law, ordinance, regulation or administrative directive, the Affirmative Action Officer of the Contract Compliance Unit of the Law Department of the City of Camden shall also:
A. 
Act as a liaison between the Affirmative Action Review Council and the Contract Compliance Unit of the City of Camden.
B. 
Gather all information necessary for the Affirmative Action Review Council to make a determination of the adequacy of an apparent low bidder's plan to attain the goals established in this chapter.
C. 
Monitor the affirmative action performance of persons subject to the provisions of this chapter.
D. 
Report to the Affirmative Action Review Council a contractor/developer's performance with respect to the provisions of this chapter and recommend to the Affirmative Action Review Council such action that may be proper to correct noncompliance with this chapter.
E. 
Issue alert notices and violation notices for a contractor's failure to comply with work force commitments under this chapter.
F. 
Provide information and referrals to the City of Camden, Bureau of Purchasing, regarding minority business enterprises as well as monitoring the City's compliance with § 14-14 of this chapter.
G. 
At the request of the Affirmative Action Review Council, perform other tasks reasonably necessary to facilitate the functions of the Affirmative Action Review Council and to facilitate the implementation of this chapter.
