§ 33-1 Establishment.

The Municipal Court heretofore established within the city, pursuant to the provisions of N.J.S.A. 2A:8-1, as amended and supplemented, is hereby continued.

§ 33-2 Name.

The name of the Municipal Court so established shall be the "Municipal Court of the City of Camden."

§ 33-3 Seal.

The Municipal Court shall have a Seal, which shall bear the impress of the name of the Court.

§ 33-4 Judges.

A. 

Each of the Judges of the Municipal Court appointed by the Mayor, with the advice and consent of the Council, as provided in § 5-13 of this Code, shall serve for a term of three years from the date of this appointment and until his successor is appointed and qualified.

B. 

Any appointment to fill a vacancy caused other than by expiration of term shall be made for the unexpired term only.

C. 

There shall be one Judge who shall be the Presiding Judge, who may be full-time or part-time and shall be so appointed or, if appointed, retained in that title for the period of his/her term.

D. 

The Municipal Court system of the City of Camden shall consist of one full-time Municipal Court Judge and two part-time Municipal Court Judges.

E. 

Limitations of practice of law by full-time Judge. The full-time Judge appointed pursuant to this section shall not engage in the practice of law or other gainful employment during his/her respective term as a full-time Judge, except to sit in another municipal jurisdiction as a Municipal Judge.

§ 33-5 Compensation of Judges.

The Judges of the Municipal Court shall be compensated by an annual salary as is more particularly set forth in the Salary Ordinance adopted by the Council. Their salaries shall be payable in the same manner as the salaries of other municipal officers. The compensation so paid shall be in lieu of any and all other fees, costs and any other allowances whatsoever.

§ 33-6 Jurisdiction, powers, functions and duties.

The Municipal Court and the Judges thereof shall have, possess and exercise all the jurisdiction, powers, functions and duties which are or may be conferred by law and the applicable rules of the Supreme Court of New Jersey.

§ 33-7 Appointment and term of office of Clerk.

A. 

There shall be a Clerk of the Municipal Court who shall be appointed by the Mayor.

B.

§ 33-8 Compensation of Clerk.

The Court Clerk shall be compensated for his services by an annual salary as more particularly set forth in the Salary Ordinance adopted by the Council, and said salary shall be payable in the same manner as the salaries of other municipal officers.

§ 33-9 Functions and duties of Clerk.

The Court Clerk shall perform such functions and duties as shall be prescribed for him by law, by the rules of the Supreme Court of New Jersey and by the Judge of the Municipal Court.

§ 33-10 Deputy Clerk.

A. 

There shall be a Deputy Clerk of the Municipal Court who shall be appointed by the Mayor.

B. 

His salary shall be payable in the same manner as the salaries of other municipal officers.

C. 

The Deputy Clerk shall assist the Municipal Court Clerk in the performance of his duties.

§ 33-11 Location.

The Municipal Court shall be held in the City Hall.

§ 33-12 When Court to sit.

The Judge of the Municipal Court shall sit at stated intervals and at such other times as the business of the Court may require, subject to the rules of the Supreme Court applicable to Municipal Courts.

§ 33-13 Fees.

A. 

The Municipal Court of the City of Camden shall be authorized to charge the appropriate fees as set forth in N.J.S.A. 22A:3-4:

B. 

Any applicant applying for the services of the Camden City Municipal Public Defender shall be required to pay an application fee of not more than $50, which fee may be waived upon the discretion of the City Municipal Judge.
