The Asbestos Hazard Abatement Subcode of the New Jersey Administrative Code, N.J.A.C. 5:23-8 et seq., except for N.J.A.C. 5:23-8.1(d), is hereby adopted by reference by the City Council of Camden as if more fully set forth herein.
For the purposes of this chapter, the following terms shall have the meanings indicated:
EMERGENCY AID
Includes any action taken by emergency services personnel in the normal course of their duties.
EMERGENCY SERVICE EQUIPMENT
Includes any equipment either used by emergency services personnel while rendering emergency aid or used to alert or summon emergency services personnel.

EMERGENCY SERVICES PERSONNEL
Includes any person authorized to provide fire, medical or police services by or for the City of Camden.

Before beginning any work at an asbestos hazard abatement site, all contractors performing asbestos hazard abatement work either in the City of Camden or for the City of Camden shall obtain a permit for that site from the Construction Code Official certifying that they have complied with the following requirements:
A. 
The contractor must provide emergency services personnel with either on- or off-site keys allowing timely access to the asbestos hazard abatement site at all times. If the site has an elevator, then the keys, provided by the contractor, must include keys to at least one elevator that has access to all levels of the site.
B. 
The contractor must identify a representative who will be available 24 hours a day during the asbestos removal. This representative must be familiar with the site and qualified to supervise the decontamination of emergency services personnel and the disposal or decontamination of emergency services equipment.
C. 
The contractor shall mark emergency service equipment at the asbestos hazard abatement site according to standards set by emergency services personnel. The contractor must notify emergency services personnel of any material changes made at or to the site. Material changes shall include but are not limited to:
(1) 
Changes affecting the operation of any emergency service equipment.
(2) 
Changes creating or closing openings in floors, walls or partitions.
(3) 
Changes which may involve the release of asbestos.
(4) 
Changes affecting air circulation.
D. 
The contractor must provide all emergency services personnel responding to emergencies at the site with access to the decontamination facilities available at the site. The contractor must also provide temporary clothing for use by emergency services personnel after decontamination,
E. 
The contractor is responsible for the disposal of all clothing used by emergency services personnel and contaminated with asbestos. The contractor is also responsible for either disposal or decontamination of all equipment used by emergency services personnel which is contaminated with asbestos. The contractor must replace any equipment that he can not decontaminate. The contractor shall use the guidelines set forth in the Precautions and Procedures during a large asbestos abatement job, N.J.A.C. 5:23-8.10(a)3, to determine whether he should dispose of or decontaminate equipment.
F. 
The contractor shall post a bond or provide a guarantor to replace or decontaminate any emergency service equipment owned by the City or its agents and used to provide emergency aid at the site. The amount of the bond is based on the volume, measured in cubic feet, of the asbestos hazard abatement site which is in any way affected by the asbestos removal. The amount of the bond shall be determined by the following table:

G. 
No contractor shall perform asbestos hazard abatement work either in the City of Camden or for the City of Camden without a valid permit issued by the Construction Code Official certifying that the asbestos hazard abatement site complies with the preceding requirements.

A. 
If any site contains a violation of this chapter, except those provisions incorporated by reference from the New Jersey Administrative Code, then the permit for that site shall cease.
B. 
Unless otherwise provided in the chapter, penalties against persons violating the provisions of this chapter shall be imposed in accordance with the provisions of § 1-15.

If an asbestos hazard abatement site at a residential property involves less than 25 linear feet of asbestos and the removal or containment of the asbestos can be completed within eight hours, then the City of Camden shall waive the bond requirement for that asbestos hazard abatement site. Nothing in this section shall be construed to remove or reduce any other obligations or requirements set forth in this chapter.
