A person commits the offense of discharge of fireworks if he/she
fires, uses, burns, explodes or sets off any firecracker, torpedo,
bomb, rocket, pinwheel, fire balloon, Roman candle or any other firecracker
or fireworks within the City.
The
following acts, actions, activities or conduct by any person, firm
or corporation are deemed to constitute fire hazards or adversely
effect the ability of the lawfully constituted fire officials to control
or extinguish fires and are declared to be unlawful within the City
of Woodson Terrace:
Negligent smoking in public hotels and motels. No
guest or occupant of any hotel, motel, rooming house, tourist court
or other place offering sleeping accommodations to the public shall
light or smoke any cigarette, pipe, cigar or other tobacco product
while sitting or lying upon any mattress, sofa or bed of any kind
in any such facility or to set fire to any mattress, bedding, furniture,
curtains, drapes, contents of wastebasket, or any other items in such
facility.
No gas or electric welding or cutting shall be done near rooms or
locations where flammable liquids, gases or vapors, lint, dust or
loose combustible stocks are so located, stored or arranged that sparks
or hot metal from the welding or cutting operations may cause ignition
to such materials.
Where welding or cutting must be done above or within ten (10) feet
of combustible construction or material or above a place where workers
and employees or where persons are likely to pass, non-combustible
shields shall be interposed to protect such materials and persons
from sparks, hot metal or oxides.
Oxygen or fuel gas cylinders and acetylene generators shall be placed
at least fifteen (15) feet away from the welding or cutting operations
so that such cylinders or tanks will not be heated by radiation from
heated materials, by sparks or slag or by misdirection of the torch
flame.
When welding or cutting operations are done above and within ten
(10) feet of combustible construction or material, a fire watcher
shall be on hand to make use of first aid fire equipment. Such fire
watcher shall be a person over twenty-one (21) years of age and shall
be trained in the use of portable first aid fire extinguishers.
One (1) or more first aid fire extinguishers of suitable construction
and type shall be kept at or near the location where the welding or
cutting operations are being performed.
No person, firm or corporation shall engage in the welding or cutting
operations without having in his/her possession or their possession
the permit required under the provisions of the laws and ordinances
of the Community Fire Protection District.
Whenever a parking lot is maintained for the use and the benefit
of the members of the public who are invited to use the facilities
of a shopping center, supermarket or mall, church, school, office
or store building, hotels or motels, then the owners, operators, managers
and lessees of such parking lot shall maintain suitable fire lanes
into such parking lot and around the buildings or improvements and
shall post signs as so designated in Subsection (4)(b) hereof.
Whenever a building has been constructed or will be constructed within
the City of Woodson Terrace where fire lanes are required pursuant
to Subsection (4)(a), such space or area shall be prohibited to the
parking of all automobiles or other obstructions and the owner or
operator of such building shall place suitable signs in conspicuous
places notifying the public that parking is prohibited. Such signs
shall be labeled "Fire Lane — No Parking" and shall not be less
than fifteen (15) square inches in size. In addition, the surface
of the pavement of such fire lanes adjoining any building shall bear
painted signs every twenty-five (25) feet in letters not less than
twelve (12) inches in height the words "Fire Lane", which signs shall
be maintained in good condition clearly visible to motorists using
such areas.
For the purpose of defining a "parking lot" as mentioned
in Subsection (4)(b) herein, it shall mean any lot, space or area,
either publicly or privately owned, where more than twenty-five (25)
automobiles are stored or parked.
