[HISTORY: Adopted by the City of Camden 1-26-2009 by Ord. No. MC-4449; amended in its entirety 10-8-2013 by Ord. No. MC-4783 (Ch. 483 of the 1987 Code). Subsequent amendments noted where applicable.]
For the purpose of this chapter, the following definitions shall apply:
CITY
The City of Camden.
DIRECTOR
The Director of Human Services of the City of Camden.
FEES
Charges the Committee requires, in an amount not to exceed the City's cost in administering each application. The committee may require a separate permit and fees for certain activities accessory to a special event, including but not limited to special parking facilities hanging banners, setting up tents, fireworks and serving alcoholic beverages or other fees due and payable under the Code of the City of Camden.
LICENSES
Those licenses required by the Code of the City of Camden for the sale of goods, the distribution of food and beverages or services.
PARADE
A procession of any kind, or any similar display in or upon any street, park or other public place in the City of Camden.
PARADE OR SPECIAL EVENT APPROVAL
The approval as required by this chapter.
PERMITS
The one-time approvals and fees for specialized or potentially hazardous activities or occupancy such as fireworks, tents, special amusement buildings.
PERSON
Any person, firm, partnership, association, corporation, company, governmental agency or organization of any kind except for the City of Camden but not excepting any autonomous agency created under the City's ordinances.
POLICE DEPARTMENT
The City of Camden Police Department. If there is no operating City of Camden Police Department, then it shall mean the "Camden County Police Department."
POLICE DIRECTOR/POLICE CHIEF
The Police Director or Police Chief, where appropriate, of the City of Camden Police Department. If both positions of Police Director and Police Chief are vacant, then it shall mean the "Police Chief of the Police Department."
REGULARLY SCHEDULED EVENTS
Activities such as sporting events, conferences and concerts which take place in accordance with an established schedule on at least three nonconsecutive dates during the calendar year.
SIDEWALK
Any area or way set aside or open to the general public for purposes of pedestrian traffic, whether or not it is paved.
SPECIAL EVENT
A preplanned event or series of events of less than a week's duration, sponsored by a public or private person or entity, which is:
A. 
Located wholly or partially on property owned or maintained by the City; or
B. 
Permissibly located on any other property and requires for its successful execution, the provision and coordination of municipal services to a degree significantly over and above that which the City routinely provides;
C. 
Any parade or other event, such as a marathon run; walkathon; leisurely walk; bike-a-thon; foot race; bicycle race; jogging group; block party requiring the closure of a street; large social event generating a parking or traffic situation that would interfere with the movement of normal traffic and/or emergency vehicles; or other activity organized by an entity or entities having a similar common purpose or goal, taking place in or upon any street, park or other public place in the City of Camden.
STREET
Any place or way set aside or open to the general public for purposes of vehicular traffic, including any beam or shoulder parkway, right-of-way, or median strip thereof.
TIME RESTRICTIONS
Those restrictions that the Committee may place on the issuance of special events permits, including without limitation a prior notice requirement, first-come, first-served scheduling, limitations on frequency of use, and limitation of permits to normal operating hours for City property.
City buildings, parks and all other City-owned or controlled real estate which have been constructed or maintained for the benefit of the public shall be for the use of the public in general. To that end, no person or entity (including City agencies) shall be given any special or exclusive privilege to use any public property under the control of the City without first obtaining a permit pursuant to this section. Additionally, there is a need to ensure that proper coordination occurs among necessary City departments to facilitate the use of City streets for special event activities including parades, street festivals, foot races, bike-a-thons, and all other requiring closure of a right-of-way.
A. 
There is hereby established a Special Events Review Committee (the "Committee"), to be made up of the following members or their designees:
(1) 
The Business Administrator.
(2) 
The Director of Human Services, who shall serve as the Chairperson of the Committee.
(3) 
The Director of Code Enforcement.
(4) 
The Risk Manager.
(5) 
The Director of Public Works.
(6) 
The Police Director/Police Chief.
(7) 
The Executive Director of the Parking Authority.
(8) 
The Emergency Management Coordinator.
B. 
Members of the Committee shall (individually and collectively) perform such duties necessary or desirable for the planning and staging of special events, but not limited to the following:
(1) 
Reviewing all applications for permits governing special events occurring within the corporation boundaries of the City and requests for attendant City support services;
(2) 
In conjunction with and under the supervision of the Director of Finance providing executive oversight of the management of any special account or fund established for management of or support for special events;
(3) 
Prior to and during every special event, coordinating the permitting processes of all City departments providing services to the special event;
(4) 
In conjunction with the Special Events Task Force (as defined herein), providing technical assistance and information to special event sponsors;
(5) 
Recommending appropriate risk management measures and time restrictions to protect the City during each special event;
(6) 
Administering through the Special Events Coordinator all special event concession agreements and all special event permits pursuant to this chapter, except those expressly reserved to other City departments or agencies;
(7) 
Forwarding all approved requests for City services to the Business Administrator at least 45 days prior to the start of the special event, to allow proper scheduling of employees;
(8) 
Having the authority to determine and require event promoters to provide essential services, including but not limited to adequate on-site safety and traffic control, fire protections, first-aid services, sanitation and clean-up;
(9) 
Subject to existing charges established in the City of Camden Code setting the rates, fees, and other charges to special event sponsors for rent and City services provided in connection with special events;
(10) 
Evaluating requests for or need for the use of City property, equipment, support services, and other resources, and submit for the Committee approval the costs to be charged to an event sponsor for such resources;
(11) 
In cooperation with the Police Department, evaluating requests to close City streets, as well as event proposals that may affect the passage of traffic through City streets, and recommend to such Committee the approval or denial of such requests and proposals;
(12) 
Evaluating the need for clean-up and sanitation services at special events, and recommend to the Committee such sanitation measures that should be required of an event sponsor;
(13) 
Coordinating the provision of City property, equipment, support services, and other resources for Committee approved special events; and
(14) 
As directed by the Business Administrator, providing technical assistance and information directly to special event sponsors on the planning, set-up and staging of events.
C. 
The Chairperson shall convene an annual meeting of the Committee no later than 90 days prior to the start of the City's fiscal year. At the annual meeting the Committee shall establish or review a schedule of fees to be charged to reimburse the City for the cost of providing incremental services attributable to a special event for the upcoming year. The schedule of fees shall be filed in the office of the Municipal Clerk prior to the date which the fees shall become effective. The Chairperson shall convene a special meeting of the Committee when it appears, based on an application received, that the issues presented by the application require the review and consultation of the Committee. The Chair may require the attendance of the members necessary to review a specific application or require the attendance of all members when appropriate.
A. 
The Director of Human Services, or his/her designee, under the supervision of the Business Administrator, shall serve as the City Special Events Coordinator. The Director, or his/her designee, shall preside as the Chairperson of the Special Events Committee. The Director, or his/her designee, may designate members of the Committee to serve as a "Special Events Task Force" with respect to a specific application.
B. 
The Department of Human Services shall maintain all administrative and financial records relating to special events, including, but not limited to, the following:
(1) 
Receiving and processing of applications;
(2) 
Correspondence with permit applicants and event sponsors, including notifications concerning permit requirements, regulations affecting special events, and application deadlines; and
(3) 
Intradepartmental correspondence and memoranda concerning the establishment of fees.
C. 
The Director of Human Services, or his/her designee, under the supervision of the Business Administrator, also shall be the primary City contact person for special event permit applicants and event sponsors.
(1) 
The Director, or his/her designee, shall evaluate all requests for services requiring Department personnel, and rental requests for City property and equipment, and consistent with the City Code determine the cost to be charged to a sponsor for provision of such services and property.
(2) 
The Director, or his/her designee, shall supervise on-site preparations for each special event and coordinate private sector support services with City services at such event.
(3) 
The Director, or his/her designee, shall forward copies to the appropriate Camden County Health personnel.
D. 
Subject to the approval of the Business Administrator, the Director, or his/her designee, shall coordinate all requests for support services for all special events approved by the Committee, including but not limited to the following tasks:
(1) 
Preparation of requests for City Services;
(2) 
Determination of estimated costs to each City operating department;
(3) 
Confirmation that application for all necessary City permits have been submitted and evaluated on a timely basis; and
(4) 
Coordination of all support services from City operating departments, both before the special events and on-site.
E. 
The Director, or his/her designee, shall evaluate the proposed location of the special event, and the projected program for the event, and notify the event sponsor of any changes in location and/or program determined by the Committee to be necessary to make the event safe in conformity with City regulations.
F. 
If the special event is expected to attract 1,000 or more participants or attendees, the Director, or his/her designee, shall ensure compliance by the sponsor with the requirements of the New Jersey Department of Health, pertaining to Emergency Medical Services ("EMS") for special events, including either:
(1) 
The use of City Fire Department personnel and equipment (at sponsor's cost); or
(2) 
Timely submission of a City special event EMS Plan for the event.
G. 
The Director, or his/her designee, shall monitor the staging of all special events, including but not limited to the following:
(1) 
Enforcement of all health, safety, vendor, licensing, and other regulations associated with any special event;
(2) 
Proper administration of all special event concession agreements and licenses, and all special events permits;
(3) 
Need for implementation of emergency management procedures; and
(4) 
Adequate provision of on-site emergency medical services.
A. 
The Department of Human Services shall convene necessary representatives of the City operating departments as the Special Events Task Force, in order to evaluate City support service requests and coordinate the provision of City resources and support services for approved special events and shall chair such Task Force.
B. 
The Department of Human Services shall review the application to determine that the City has adequate personnel and equipment to service the special event and adequate provisions have been made to reimburse the City for the costs incurred by it.
C. 
The Department of Human Services shall monitor all costs to the City associated with the planning and staging of special events, including scheduled overtime of City employees, to ensure that City departments do not exceed fiscal year overtime projections.
D. 
The Department of Human Services shall not approve an application involving special events or parades unless said application has also been approved by the Police Department as provided in § 716-9A herein and Chapter 534, Parades, of the Code of the City of Camden.
E. 
Final approval of all special event applications shall be from the Mayor, Business Administrator, City Attorney, and Finance Director.
The Director of Code Enforcement or the Director's designee shall represent that office at all meetings of the Committee. The Director of Code Enforcement or the Director's designee shall enforce the provisions of the City Code dealing with the licensing of structures or the sale or distribution of merchandise, food or services. The Director of Code Enforcement or the Director's designee's duties shall include, but not limited to, the following:
A. 
Enforcing licensing requirements;
B. 
Collection of fees licensing associated with special events;
C. 
Enforcement procedures;
D. 
Providing on-site code enforcement personnel; and
E. 
Reviewing plans for applicability to certificate of occupancy for one-day events.
A. 
The Risk Manager shall represent the Office of Risk Management at all meetings of the Committee.
B. 
The Risk Manager shall evaluate special event applications and advise the Committee on appropriate risk management measures to protect the City from liability during an event, including but not limited to amounts and types of insurance to be required of event sponsors.
The City Attorney shall provide legal advice to the Committee on all matters relating to the consideration of special events permit applications and the conduct of special events, including but not limited to the following:
A. 
Permit requirements;
B. 
Indemnification, insurance, and risk management issues;
C. 
Leasing of public space;
D. 
Ordinance and regulation requirements; and
E. 
Special events policy oversight.
A. 
Except as otherwise expressly provided in this chapter, nothing herein shall alter the requirements of the provision of Chapter 534, Parades, of the City of Camden Code dealing with parades. Final approval of all parade permits shall be from the Mayor, Business Administrator, City Attorney, Finance Director, and Police Director/Police Chief. The parade permit application pursuant to Chapter 534 shall be distributed by the Department of Human Services, and a true copy of said application shall also be simultaneously filed with the Police Director/Police Chief and his/her approval obtained as required in § 716-9. No parade or special event applications shall be approved until the Department of Human Services receives approval from the Police Director/Police Chief for all applications for parades or street closures associated with the event.
B. 
The Police Director/Police Chief shall determine whether and to what extent additional police protection is reasonably necessary for the parade or special event for traffic control and public safety. The Police Director/Police Chief shall base this decision on the size, location, duration, time and date of the event, the expected sale or service of alcoholic beverages, the number of streets and intersections blocked, and the need to detour or preempt citizen travel and use of the streets and sidewalks. The speech content of the event shall not be a factor in determining the amount of police protection necessary. If possible, without disruption of ordinary police services or compromise of public safety, regularly scheduled on-duty personnel will police the event. If additional police protection for the parade or special event is deemed necessary by the Police Director/Police Chief, he shall so inform the applicant. Then, for the Police Director/Police Chief's approval, the applicant shall have the duty to secure the police protection deemed necessary by the Police Director/Police Chief, at the sole expense of the applicant.
C. 
The Police Director/Police Chief shall appoint a member of the Police Department to serve as the Special Events Liaison. All matters concerning special events shall be directed to said Liaison. The Police Director/Police Chief shall advise the Director of Human Services of this designation or any changes made in this designation. If the Special Events Liaison designated by the Police Director/Police Chief or the Police Chief determine that the event requires that the Police Department provide security and traffic control above and beyond that provided by the Department through regularly assigned personnel, the Department shall indicate to the organizer of an event the number of additional police officers that will be required to provide these services. The costs of these incremental services shall be borne by the event organizer. No permit shall be granted until the organizer executes a contract with the Police Department to provide these services through the Department's secondary employment program or such other arrangement which shall be approved by the Department and makes the deposit required to reimburse the Department for the cost of providing these incremental services.
D. 
Persons engaging in special events or parades conducted for the sole purpose of public issue speech protected under the First Amendment are not required to pay for any police protection provided by the City.
E. 
The Police Director/Police Chief shall have a minimum of 48 hours to approve or deny any permit application. The review conducted by the Police Director/Police Chief shall be conducted as set forth in this chapter.
The Fire Department shall advise the Special Events Coordinator of any fire protection issues presented by an application and any cost issues.
The Department of Public Works shall advise the Special Events Coordinator of the impact of the application on that Department including costs to be incurred.
The Special Events Coordinator shall maintain a current schedule of all County-sponsored events to be held within the City and act as the City's liaison with the County of Camden.
No person shall engage in or conduct any parade or special event unless a permit is issued pursuant to the provisions of this chapter.
This chapter shall not apply to the following:
A. 
Funeral processions;
B. 
Students going to and from school classes or participating in educational activities, provided that such conduct is under the immediate direction and supervision of the proper school authorities and does not impact flow or control of traffic;
C. 
A governmental agency acting within the scope of its functions;
D. 
Spontaneous events occasioned by news or affairs coming into public knowledge within three days of such special event, provided that the organizer thereof gives written notice to the Director of Human Services, or his/her designee, and Police Director/Police Chief at least 24 hours prior to such parade or special event;
E. 
Political rallies or motorcades that do not impact on traffic control or public safety, occurring in a series of six or more nonconsecutive days during a calendar year;
F. 
Regularly scheduled events provided that notice of the scheduled events is given to the Director, or his/her designee, at least 30 days prior to the first scheduled event of that series of events provided that the sponsors of the event comply with all other applicable City ordinances; and
G. 
Events taking place within a venue such as a stadium, amphitheater or auditorium specifically designed to accommodate events provided that the event will take place entirely within the confines of said stadium, amphitheater or auditorium and the attendance at the event will not exceed the normal capacity of that structure.
All City government officials, departments, agencies, boards and commissions sponsoring a special event on City property shall comply with the application procedures and other requirements set forth in this chapter; provided, however, that unless otherwise directed by the Committee, such City entities shall not be required to pay the fees and charges set forth here.
A. 
A person seeking a special event permit shall file an application with the Director, or his/her designee, on forms provided by the Director and the application shall be signed by the applicant under oath. Upon receipt of the application, the Director, or his/her designee, shall review the application for completeness. Incomplete applications shall be returned to the applicants without unreasonable delay together with a written statement setting forth the deficiencies in the applications. Parade applications shall be forwarded to the Police Department without delay. The Director, or his/her designee, shall forward a copy of said application to each of the persons and agencies set forth in this chapter. The copy forwarded to the Police Director/Police Chief shall contain any comments and recommendations submitted by the Director, or his/her designee, or any of the persons or agencies set forth in this chapter.
B. 
For single, nonrecurring parades or special events, an application for a permit shall be filed with the Director, or his/her designee, at least 60 and not more than 180 days before the parade or special event is proposed to commence. The Director, or his/her designee, may waive the minimum thirty-day filing period and accept an application filed within a shorter period if, after due consideration of the date, time, place, and nature of the parade or special event, the anticipated number of participants, and the City services required in connection with the event, and in consultation with the Business Administrator and the Police Director/Police Chief, the Director, or his/her designee, determines that the waiver will not present a hazard to public safety.
C. 
For parades or special events held on a regular or recurring basis at the same location, an application for a permit covering all such parades or events during that calendar year may be filed with the Director, or his/her designee, at least 30 and not more than 180 days before the date and time at which the first such parade or special event is proposed to commence.
D. 
The application for a parade or special event approval shall set forth the following information:
(1) 
The name, address and telephone number of the person seeking to conduct such parade or special event;
(2) 
The names, addresses and telephone numbers of the organization for which the parade or special event is to be conducted, if any, and the authorized and responsible heads of the organization;
(3) 
The requested date of the parade or special event;
(4) 
The route to be traveled, including the starting point and the termination point;
(5) 
The approximate number of persons who and animals and vehicles which will constitute such parade or special event, and the type of animals and description of the vehicles;
(6) 
The hours when such parade or special event will start and terminate.
(7) 
A statement as to whether the parade or special event will occupy all or only a portion of the width of the streets proposed to be traversed from start to finish;
(8) 
The location by street of any assembly areas for such parade or special event;
(9) 
The time at which units of the parade or special event will begin to assemble at any such area;
(10) 
The intervals of space to be maintained between units of such parade or special event;
(11) 
If the parade or special event is designed to be held by, or on behalf of, any person other than the applicant, the applicant for such approval shall file an affidavit from that person with the Director, or his/her designee, authorizing the applicant to apply for the permit on his behalf;
(12) 
The type of special event, including a description of activities planned during the event;
(13) 
A description of any recording equipment, sound amplification equipment, banners, signs, or other attention-getting devices to be used in connection with the parade or special event;
(14) 
The approximate number of participants (spectators are by definition not participants);
(15) 
The approximate number of spectators;
(16) 
A designation of any public facilities or equipment to be utilized;
(17) 
The toilet facilities being provided (and copies of contracts for these services); and
(18) 
Any additional information that the Director, or his/her designee, finds reasonably necessary to a fair determination as to whether a permit should be issued.
A. 
If this event is to include sales of goods or food, at least 15 days prior to the date of the event, the sponsor must submit a list of all participating vendors and the one-time special event fee application in lieu of the mercantile license fee for each vendor authorized to sell at the event and not holding a current license. A licensed City vendor must also submit an application if he will sell items different from what is authorized to vend, or if his current license otherwise does not allow him to sell at the special events. Vendors selling food will also need prior approval from the Camden County Health Department and Department of Code Enforcement.
B. 
Any person satisfying the application requirements of this chapter may, at the discretion of the Director of the Department of Code Enforcement, be issued a one- to three-day special events peddler's license and/or vending unit registration. A one-day licensee shall permit the licensee to conduct the business activities of a peddler within the City of Camden according to the provisions of this chapter and all other applicable provisions of the Code. A one-day license period shall extend for a single twenty-four-hour period beginning at 12:00 a.m. on the date specified on the license. All provisions of the City of Camden Code shall apply to a one-day licensee.
A. 
A non-refundable fee of $25 to cover the administrative costs of processing the application shall be paid to the City of Camden by the applicant when the application is filed.
B. 
If the application is for the use of any City property or if any City services shall be required for the parade or special event, the applicant shall pay, prior to the issuance of a permit, the charges for those services in accordance with a schedule of service costs approved by the City Council by ordinance.
C. 
The Mayor may waive the fee under circumstances where, after consultation with the City Attorney, the Mayor determines that the imposition of a fee would unduly restrict the exercise of the applicant's or participant's constitutional rights.
D. 
The sponsor shall deposit with the City within 20 days prior to the event a sum as determined by the Director, or his/her designee, sufficient to reimburse the City for the incremental cost incurred in providing police and fire service and the cost of transport, assembly and securing of equipment and vehicles such as stages, bleachers, flat beds or other City-owned equipment and connection fees and meter charges for the use of any water for fire hydrants or service lines. Reimbursement will be sought for the cost of preparing and installing and removing barricades, trash containers utilized that cannot be replaced such as trash bags, equipment and manpower utilized to stage, operate and clean up after the event.
E. 
Every person or entity sponsoring a special event involving sale of items, charging of admissions, or closure of more than one block of City street, shall comply with the following requirements:
(1) 
Obtain a special event permit pursuant to the fee schedule; provided, however, that prior to the issuance of a permit to use City property managed by a City department or agency other than one represented on the Committee, the director of the affected department or agency must consent to the issuance of the permit;
(2) 
Submit an application in a form approved by the Committee within such time period prior to the special event as may be established by the Committee;
(3) 
If the special event is to be located wholly or partially on property owned, leased or maintained by the City, the applicant shall pay use fees in scheduled amounts as may be determined from time to time by the Committee and published in this City of Camden Municipal Ordinances;
(4) 
Except as otherwise provided herein, pay all costs, at scheduled rates as determined from time to time by the Director, or his/her designee, in consultation with the affected City department or designee and approved by the Committee, for services and equipment exceeding normal service levels incurred during a special event by City departments and agencies;
(5) 
Services.
(a) 
The provision of services in compliance with all applicable City Codes and regulations, including without limitation:
[1] 
Event security and traffic control;
[2] 
Crowd management;
[3] 
Food preparation facilities;
[4] 
Waste and litter control;
[5] 
Toilet facilities; and
[6] 
Fire and emergency medical facilities and personnel.
(b) 
And any other services necessary to ensure that an event is conducted in a safe manner to protect the safety, health, property, and general welfare of the City's citizens, as determined by the Committee. Security services must be provided by City police officers or a reputable outside provider approved by the Committee in advance. The sponsor must also hire other City and/or outside personnel as may be required by the Committee to perform other necessary health and safety functions.
(6) 
Special events vendor licenses.
(a) 
If the special event is to include sale of goods or food, submit to the City a list of all participating vendors together with a completed special events vendor license application for each vendor authorized by the sponsor to sell at the special event and not holding a current City vendor license, and remit the required fee per vendor as a license fee, provided that if such applications and license fees are not submitted to the City at least 10 days prior to the first day of the special event, a late fee for each application shall be due and payable at the time of submission.
(b) 
Notwithstanding the above, if a holder of a current City vendor license participates in a special event under conditions different from or not permitted under the terms of the holder's license, the sponsor shall be required to submit a special event vendor license application and remit the required fee for such vendor;
(7) 
At least 10 business days prior to the first day of the special event, post a bond or cashier's check in the amount of the estimated cost of City services as determined by the Committee, as well as the amount of any other sums due and payable to the City upon the occurrence of the special event. If after the special event the City determines that the actual cost was less than the amount posted, funds will be reimbursed as promptly as possible. If the actual cost of City services exceeds the posted amount, payment must be made within 15 calendar days after the City invoices the sponsor for these costs; and
(8) 
Submit an independently audited statement of gross revenues derived from the special event within such time period after the special event as may be specified by the Committee.
The Committee shall establish and publish special event rental rates, services cost recovery amounts, and other fees to be paid by applicants pursuant to this chapter. The current rates and charges shall be as attached to this chapter.[1]

The Director of Human Services, or his/her designee, shall issue an approval as provided for herein when, from a consideration of the application and from such other information as may otherwise be obtained, he finds that:
A. 
The conduct of the parade or special event will not substantially interrupt the safe and orderly movement of other pedestrian or vehicular traffic contiguous to its route or location;
B. 
The conduct of the parade or special event will not require the diversion of so great a number of City police officers to properly police the line of movement and the areas contiguous thereto as to prevent normal police protection of the City;
C. 
The concentration of persons, animals and vehicles at public assembly points of the parade or special event will not unduly interfere with proper fire and police protection of, or ambulance service to, areas contiguous to such special event areas;
D. 
The conduct of the parade or special event is not reasonably likely to cause injury to persons or property;
E. 
The parade or special event is scheduled to move from its point of origin to its point of termination expeditiously and without unreasonable delays on route;
F. 
Adequate sanitation and other required health facilities are or will be made available in or adjacent to any special event areas;
G. 
There are sufficient parking places near the site of the parade or special event to accommodate the number of vehicles reasonably expected;
H. 
The applicant has secured the police protection, if any, required by this chapter;
I. 
A parade or special event approval application for the same time and location is already granted or has been received and will be granted, and the police resources required for that prior parade or special event is not so great that in combination with the subsequent proposed application, the resulting deployment of police services would have an immediate and adverse effect upon the welfare and safety of persons and property; and
J. 
No event is scheduled elsewhere in the City where the police resources required for that event are so great that the deployment of police services for the proposed parade or special event would have an immediate and adverse effect upon the welfare and safety of persons and property. No permit shall be granted that allows for the erection or placement of any structure, whether permanent or temporary, on a City street, sidewalk, or right-of-way unless advance approval for the erection or placement of the structure is obtained from the City Council of Camden.
The City officials authorized under this chapter shall uniformly consider each application upon its merits and shall not discriminate in granting or denying permits under this chapter based upon political, religious, ethnic, race, disability, sexual orientation or generally related grounds.
The Director of Human Services, or his/her designee, shall act promptly upon a timely filed application for a parade or special event approval but in no event shall grant or deny an approval less than 30 days prior to the event. If the Director, or his/her designee, disapproves the application, he shall notify the applicant either by personal delivery or certified mail at least 30 days prior to the event of his action and state the reasons for denial.
A. 
The Director of Human Services, or his/her designee, in denying an application for a parade or special event permit, may authorize the conduct of the parade or special event at a date, time, location, or route different from that named by the applicant. An applicant desiring to accept an alternate permit shall, within five days after notice of the action of the Director, or his/her designee, file a written notice of acceptance with the Director, or his/her designee.
B. 
An alternate parade or special event permit shall conform to the requirements of, and shall have the effect of, a parade or public assembly approval issued under this chapter.
C. 
All applications for street closing permits to be issued for special events, nonresident-sponsored block parties, or any other unusual activity, shall cost $5 per block. This application fee must be posted with the appropriate application no later than 50 days prior to the expected first day of the activity. Applications submitted within 50 days of the first day of the activity must be accompanied by payment of a $5 late fee. The fees shall be payable only by check or money order payable to the City, and shall be nonrefundable. All closures of City streets in conjunction with a special event shall be approved by the Committee after consultation with the Police Director/Police Chief and Public Works Director.
A. 
Any applicant shall have the right to appeal the denial of a parade or special event approval to the City Business Administrator. The denied applicant shall make the appeal within five days after receipt of the denial by filing a written notice with the Director of Human Services, or his/her designee, and a copy of said notice with the Business Administrator. The Business Administrator shall act upon the appeal within three days following receipt of the notice of appeal.
B. 
In the event that the Business Administrator rejects an applicant's appeal, the applicant may file an immediate request for review with a court of competent jurisdiction.
A. 
Immediately upon the application of a parade or special event permit, the Director of Human Services, or his/her designee, shall send a copy thereof to the following:
(1) 
The Mayor;
(2) 
The Business Administrator;
(3) 
The City Attorney;
(4) 
The Police Director/Police Chief;
(5) 
The Director of Code Enforcement;
(6) 
The Fire Chief;
(7) 
The Director of Public Works;
(8) 
The Public Information Officer;
(9) 
The City Risk Manager;
(10) 
The City Emergency Management Coordinator; and
(11) 
The manager or responsible head of each public transportation utility, the regular routes of whose vehicles will be affected by the route of the proposed parade or special event.
B. 
Within five business days the City employees mentioned above shall furnish the Director of Human Services, or his/her designee, information as to the expenses and City equipment required to support the parade or special event.
C. 
The Police Director/Police Chief, in conjunction with the Director of Human Services, or his/her designee, shall coordinate the provisions of City services necessary to support the parade or special event. The Police Department shall coordinate the provision of public safety measures as well as request for Code Enforcement/Fire protection services. The Director of Human Services, or his/her designee, shall coordinate the provision of other necessary services and to the extent necessary, any arrangement that must be made with non-City agencies.
Each parade or special event permit shall state the following information;
A. 
Starting and approximate ending time;
B. 
Minimum speed of parade units;
C. 
Maximum speed of parade units;
D. 
Maximum interval of space to be maintained between parade units;
E. 
The portions of the streets that may be occupied by the parade or special event;
F. 
The maximum length of the parade in miles or fractions thereof; and
G. 
Such other information as the Director of Human Services, or his/her designee, and the Committee shall find necessary for the enforcement of this chapter.
A. 
An applicant hereunder shall comply with all approval directions and conditions and with all applicable laws and ordinances.
B. 
The parade or special event chairman or other person heading such activity shall carry the parade or special event approval upon his person during the conduct of the parade or special event.
The following prohibitions shall apply to all parades and special events:
A. 
It shall be unlawful for any persons to state, present, or conduct any parade or special event without first having obtained an approval as herein provided;
B. 
It shall be unlawful for any person to participate in a parade or public assembly for which the person knows a permit has not been granted;
C. 
It shall be unlawful for any person in charge of, or responsible for the conduct of, a duly licensed parade or special event to knowingly fail to comply with any condition of the permit;
D. 
It shall be unlawful for any person to participate in any parade or special event activity that would constitute a substantial hazard to the public safety or that would materially interfere with or endanger the public peace or rights of residents to the quiet and peaceful enjoyment of their property;
E. 
It shall be unlawful for any person participating in any parade or public assembly to carry or possess any length of metal, lumber, wood, or similar material for purposes of displaying a sign, poster, plaque or notice, unless such object is 1/4 inch or less in thickness and two inches or less in width, or if not generally rectangular in shape, such object shall not exceed 3/4 inch in its thickest dimension;
F. 
It shall be unlawful for any person to carry any sign, poster, plaque, or notice, whether or not mounted on a length of material as specified in Subsection E of this section, unless such sign, poster, plaque, or notice is constructed or made of a cloth, paper, or cardboard material; and
G. 
It shall be unlawful for any person to ride, drive, or cause to be ridden or driven any animal or any animal-drawn vehicle upon any public street, unless specifically authorized by the permit.
H. 
For any community or special event supported and sponsored by the City, in whole or in part, any and all political organizing activity occurring at the same time as part of the community or special event shall be strictly prohibited.
A. 
No person shall unreasonably hamper, obstruct or impede, or interfere with any parade or special event or with any person, vehicle or animal participating or used in a parade or special event.
B. 
No driver of a vehicle shall drive between the vehicles or persons comprising a parade or special event when such vehicles or persons are in motion and are conspicuously designated as a parade or special event.
C. 
The Police Department, in consultation with Director of Human Services, or his/her designee, shall have the authority, when reasonably necessary, to prohibit or restrict the parking of vehicles along any street constituting a part of the route of a parade or special event. The Police Department shall post signs to that effect, and it shall be unlawful for any person to park or leave unattended any vehicle in violation thereof. No person shall be liable for parking on a street unposted in violation of this chapter.
The Police Department, in consultation with the Director of Human Services, or his/her designee, shall have the authority to revoke a parade or special event approval instantly upon violation of the conditions or standards for issuance as set forth in this chapter or when a public emergency arises where the police resources required for that emergency are so great that deployment of police services for the parade or special event would have an immediate and adverse effect upon the welfare and safety of persons or property.
Unless otherwise provided in this chapter, penalties against persons violating the provisions of this chapter shall be imposed in accordance with the provisions of § 1-15 of the City Code.
