As used in this article, the following terms shall have the
meanings indicated:
A transportable, weather-resistant receptacle designed and
used primarily for temporary storage of building materials, household
goods, or other materials which is typically delivered and removed
by motor vehicle. A commonly used name for these storage containers
is "PODS," an acronym for "portable on demand storage," which are
subject to this article.
Portable storage containers shall be restricted to no larger
than eight feet wide, 20 feet long and eight feet high.
There shall be no more than one portable storage container per
lot at any given time without the express written permission of the
City as provided in this article.
A.
During construction, a portable storage container may be used to
store on-site tools and materials to be used for an initial permit
period of 90 days. A permit may be extended for an additional period
of 90 days upon request to the Director of Code Enforcement. The portable
storage container must be removed within 30 days of completion or
cessation of construction or the expiration of the construction permit,
whichever event occurs first.
B.
The use of a portable storage container for purposes which are other
than construction, such as moving, is permitted for not more than
30 days per dwelling unit in a 360-day period.
Unless approved in writing by the Director of Code Enforcement,
the location of a portable storage container shall:
A.
Comply with side and rear zoning setback requirements for the zoning
district in which it is located.
B.
Not be placed in front of the front foundation of the house or other
primary structure of the property. The term "front foundation" as
utilized herein shall mean the side of the house or primary structure
located closest to the highway upon which the property fronts.
C.
At no time be situated on any lot where its placement would impair
or obstruct visual sight lines to any public thoroughfare.
D.
Only be placed upon an approved parking area such as driveways and
parking lots. If space is available at the side yard or rear yard
of the lot, the portable storage container may be placed on the side
yard or rear yard of the lot.
E.
Not be permitted to be placed on City streets. Portable storage containers
shall not be allowed to be placed or unloaded on any City street or
right-of-way under any circumstances.
No portable storage container shall be used to store solid waste,
construction debris, demolition debris, recyclable materials, business
inventory, commercial goods, goods for property other than that of
the property where the portable storage container is located (i.e.,
used for retail sales) or any other illegal or hazardous material.
Upon reasonable advance notice to the property owner and/or operator,
the City may inspect the contents of any portable storage container
at any reasonable time to ensure that it is not being used to store
any of the aforesaid prohibited items and materials. At no time shall
a portable storage container be used for any illegal purpose.
The owner and/or operator of any lot on which a portable storage
container is placed shall be responsible for ensuring that the portable
storage container is maintained in good condition, free from evidence
of deterioration, weathering, discoloration, graffiti, rust, ripping,
tearing or other holes or breaks, at all times. When not in use, the
portable storage container shall be locked.
The permit issued under this article shall be issued by the
Department of Code Enforcement, Division of License and Inspections.
The permit fee shall be $69 monthly, paid in advance to the Department
of Code Enforcement, Division of License and Inspections.
