It is the intent of the Borough Council of the Borough of Dormont
to organize an authority under provisions of the Municipality Authorities
Act.[1]

The name of the Authority shall be the "Borough of Dormont Stormwater
Authority."
The proposed Articles of Incorporation of said Borough of Dormont
Stormwater Authority are as follows.[1]

The first members of the Board of said Borough of Dormont Stormwater
Authority, names in the aforesaid Articles of Incorporation, are specifically
appointed members of said Board for the terms set after their respective
names, commencing on the date of appointment and computed from the
first Monday in January, 2016.
A.
The President of the Borough is hereby authorized and directed to
execute the Articles of Incorporation of the proposed Borough of Dormont
Stormwater Authority in substantially the form set forth in this chapter,
and the Borough Secretary of the Borough is hereby authorized and
directed to execute and deliver such other documents, agreements,
certificates and instruments and to do all acts necessary or appropriate
to effect the incorporation of the proposed Borough of Dormont Stormwater
Authority, including, but not limited to, to cause notice of the substance
of this chapter, including the substance of the foregoing Articles
of Incorporation, and the proposed filing of such Articles of Incorporation,
to be published as required by the Municipality Authorities Act.[1]

B.
The President of the Borough and the Borough Secretary of the Borough
are authorized and directed to file such Articles of Incorporation
and necessary proofs of publication with the Secretary of the Commonwealth
of Pennsylvania and to do all other things necessary to effect the
incorporation of the Borough of Dormont Stormwater Authority, including
payments of the required filing fees.
The Borough of Dormont Stormwater Authority shall have all of
the purposes, powers, and rights as provided by Act 68 of 2013,[1] and Act 123 of 2014,[2] including, but not limited to, purposes of financing working
capital; acquiring, holding, constructing, financing, improving, maintaining
and operating, owning or leasing, either in the capacity of lessor
or lessee, projects of the following kind and character and providing
financing for insurance reserves: stormwater planning, management
and implementation as defined in the Articles of Incorporation.
In the event any provision, section, sentence, clause or part
of this chapter shall be held to be invalid or unconstitutional, such
invalidity or unconstitutionality shall not affect or impair any remaining
provision, section, sentence, clause or part of this chapter, it being
the intent of this Borough that such remainder shall be and shall
remain in full force and effect.
