All roads, public alleys, curbs and gutters laid within the corporate limits of St. Michaels shall be under the complete control and jurisdiction of The Commissioners of St. Michaels and shall be constructed under the supervision of said Commissioners, or such agent or supervisor as they shall designate.
A. 
All public roads shall be constructed and maintained with asphalt or other material surface that provides a safe driving surface. New roads shall be constructed in accordance with Chapter 290.
B. 
All alleys shall be constructed and maintained in working condition with gravel that provides a safe driving surface.
All curbs and gutters shall be constructed of cement. All curbs and gutters shall be properly faced. The inside gutter line shall correspond with the outside curbline. The gutter shall have a gradual and upward inclination toward the middle of the street. The Commissioners may elect to authorize a departure from the specifications of this section as they deem appropriate.
It shall be unlawful to plant any post or tree, or create other obstruction, in the street outside the established curbline, nor shall any such be planted within the line of the curb upon the sidewalk without the written permission of said Commissioners first had and obtained.
No person shall maliciously or recklessly destroy, damage or deface any curb, gutter, sidewalk or other work in the public way in course of construction or after completion. Violations of this provision shall be enforced by the police and shall constitute a misdemeanor in addition to a municipal infraction.
Any person or persons, or its agent or agents, who shall violate any provisions of any section of this article wherein a penalty for violation of the same has not been heretofore provided shall be charged with a municipal infraction which shall carry a fine of $250 plus the costs of any repairs.
A. 
No person or persons shall dig, alter or tear up any roadbed, street, curb, gutter or public alley within the limits of St. Michaels, for any purpose whatsoever, without first obtaining a permit to do so from the Commissioners of St. Michaels.
B. 
No person or persons shall damage, intentionally or not, any roadbed, street, curb, gutter or public alley within the limits of St. Michaels, for any purpose whatsoever, including damage caused by deliveries to a property.
C. 
Responsibility for repairs due to damage caused by a property owner or delivery to a property will be borne by the property owner to whom such deliveries and/or services were rendered. Method and extent of correction shall be determined by the Town.
D. 
If the owner or owners of record of any lot or premises fronting on or binding on any street or alley of the Town of St. Michaels shall fail to pay or repay the costs of any work authorized by this section after due notice has been provided by the delivery of certified mail or the posting of the subject property, the Commissioners of St. Michaels may assess the cost of the work and all costs of collection against the property which shall constitute a lien thereon and collect the same in the same manner that other taxes are collected.
