This article shall be known and may be cited as the "Public Urination and Defecation Ordinance."
It is the intention of The Commissioners of St. Michaels by this article to prohibit public urination and defecation in order to maintain public order and preserve the beauty of the Town, and safeguard the health, welfare and safety of the citizens of the Town.
As used in this article, the following words or phrases shall have the following meanings:
PUBLIC OR PRIVATE PROPERTY
The right-of-way of any road or highway; any body of water or watercourse or the shores or beaches thereof; any park, parking facility, playground, public service company property or transmission line right-of-way, building, refuge or conservation or recreation area, any residential or farm properties, timberlands or forest.
It shall be unlawful for any person to urinate or defecate on any public or private property in this Town, or any waters in this Town, unless:
A. 
Such urination or defecation is done within a bathroom or rest room; or
B. 
Such person is the owner or tenant in lawful possession of such property; or has first obtained consent of the owner or tenant in lawful possession.
Any sworn police officer of the Town shall be empowered to enforce the provisions of this article.
A. 
Any person who shall commit a prohibited act as set forth in this article shall be guilty of a municipal infraction, and subject to the procedures set forth in Chapter 33, Municipal Infractions.
B. 
Each separate violation of this article shall constitute a separate offense.
C. 
Each violation of this article shall be punishable by a fine of $25 for a first offense and by a fine of $50 for any subsequent offense.

This article shall be known and may be cited as the "Landing of Aircraft Ordinance."
It is the purpose of this article to limit the landing of helicopters, specifically, and any other aircraft, in general, to areas that are equipped to safely accommodate such landings and which are located in areas sufficiently removed from residential zones so as to insure the safety of the residents of and visitors to the Town.
As used in this article, the following words shall have the following meanings:
AIRCRAFT
Any device carrying or capable of carrying one or more persons through the air, including airplanes, gliders, helicopters, balloons and other lighter aircraft, parachutes and any other similar device.
A. 
No person shall land, or cause to be landed, any helicopter or other aircraft anywhere in the incorporated Town of St. Michaels except:
(1) 
In the case of an emergency.
(2) 
At a location which The Commissioners of St. Michaels, by resolution thereof, shall designate as an authorized location for the landing of aircraft.
B. 
This section is not intended to apply to aircraft owned or operated by a federal or state governmental agency.
