This chapter shall be known and may be cited as the "Littering Law of the Incorporated Village of Sea Cliff."
For the purposes of this chapter, the terms used herein are defined as follows:
LITTER
Garbage, refuse and rubbish as otherwise defined in this Code,[1] and all other waste and discarded material of any kind which, if thrown or deposited as herein prohibited, tends to create a nuisance or danger to public health, safety and welfare.
MOTOR VEHICLE
A mechanical device for the conveyance of people, animals, materials or any combination thereof, operated or driven upon streets by any power other than muscular power.

No person shall throw or deposit litter in or upon any street, sidewalk, parking lot, beach, park or other public place within the Village, except in receptacles intended for the deposit or collection thereof or in authorized disposal areas. Where designated receptacles are not provided, all such litter shall be carried away by the person responsible for its presence and properly disposed of elsewhere.
No person shall throw or deposit litter in or upon any private property within the Village, except in receptacles intended for the deposit or collection thereof.
Persons placing litter in receptacles or in authorized disposal areas shall do so in such a manner as to prevent it from being carried or deposited by the elements upon any street, sidewalk or other public place or upon private property.

No person shall sweep into or deposit in any gutter, street, catch basin, drainage system or other public place within the Village any litter from any building or lot or from any public or private sidewalk or driveway.
A. 
Persons owning or occupying property shall keep the sidewalk in front of their premises free of litter.[1]

B. 
The occupant or proprietor of any premises open to the public shall keep the sidewalks, parking areas and driveways on and around such premises free of litter.
C. 
The occupant or proprietor of any premises open to the public shall maintain a sufficient number of receptacles in, on and around said premises for the deposit or collection of litter.
No person, while a driver or passenger in or upon a motor vehicle, shall throw or deposit litter upon any street or other public place or upon private property within the Village.
No person shall control, drive or operate any motor vehicle within the Village unless such vehicle is so constructed or loaded as to prevent any load, contents or litter from falling, being blown or deposited upon any street or other public place or upon any private property within the Village, unless pursuant to and required by the performance of repair or maintenance work.
No person shall throw or deposit litter in any fountain, pond, stream, bay, or any other body of water within the Village.
