It is the intent of this article to opt the Village of Irvington out of permitting retail cannabis dispensaries and on-site cannabis consumption establishments within its boundaries.
This article is adopted pursuant to § 131 of the Marihuana Regulation and Taxation Act (MRTA).
No cannabis retail dispensary and no cannabis on-site consumption establishment is permitted in the Village of Irvington.
All ordinances, local laws, and parts thereof inconsistent with this article are hereby repealed.
This article shall take effect upon filing with the Secretary of State. As required by the MRTA, the article is subject to a permissive referendum and, therefore, may not be filed with the Secretary of State until 30 days have elapsed after enactment of this article or, if a petition is filed within that period, until a referendum has been conducted approving this article.[1]
