[Amended at time of adoption of Code (see Ch. 1, General
Provisions, Art. I)]
New sanitary sewers and all extensions to sanitary sewers to
be installed within the Town of Webster's Town-wide Sewer District
or areas tributary thereto shall be designed by a professional engineer
licensed to practice sewer design in New York State, in accordance
with the recommended standards for sewage works ("Ten State Standards"),
as adopted by the Great Lakes - Upper Mississippi River
Board of State Sanitary Engineers, design and criteria requirements
for the Town of Webster's Town-wide Sewer District sewers, and in
strict conformance with all requirements of the New York State Department
of Environmental Conservation. Plans and specifications shall be submitted
to, and written approval shall be obtained from, the Monroe County
Department of Health, the Town of Webster Sewer Department, the NYSDEC,
and all agencies having jurisdiction over same, before initiating
any construction. The design shall anticipate and allow for flows
from all possible future extensions and should be extended to the
limits of property as determined by the Commissioner of Public Works
or Superintendent or his/her duly authorized agent. If, however, there
is inadequate capacity in any sewer which would convey the wastewater
or if there is insufficient capacity in the POTW to treat the wastewater
properly, the application shall be denied. Sewer line and POTW current
use shall be defined as the present use and the utilized use which
has been committed, by resolution, to other users by the Webster Town
Board.
When a property owner, builder, or developer proposes to construct sanitary sewers or extensions to sanitary sewers in an area proposed for subdivision or development, the plans, specifications, and method of installation shall be subject to the approval of the Monroe County Health Department, the Town of Webster Sewer Department, and all other agencies having jurisdiction over same, in accordance with §
257-25. Said property owner, builder, or developer shall pay for the entire design, review of the design by the Town, inspection and testing by the Town of Webster Sewer Department and installation. He or she shall also pay for his or her proportionate share of the cost for any required upgrading of the existing treatment plant, intercepting or trunk sewers, pumping stations, force mains, and all other expenses incidental thereto which may be required as a result of rezoning or obtaining variances from existing zoning that increases wastewater flow above that quantity generated from development based on conformance with current zoning, or as a result of projects which will enlarge the service area or increase hydraulic or treatment plant demands on the POTW. (See §
257-177, Impact fees.) Each street lateral shall be installed and inspected pursuant to Article
VI, and estimated inspection fees shall be paid by the applicant prior to initiating construction. Design and installation of sewers shall be as specified in the design and criteria requirements for the Town of Webster, and in conformance with Paragraphs 3 through 6 of ASTM Specification C-12. The installation of the sewer shall be subject to periodic inspection by the Town of Webster Sewer Department, without prior notice. The Commissioner of Public Works or Superintendent or his or her duly authorized agent shall determine whether work on Town sewers is proceeding in accordance with the approved proposed plans and specifications, and whether the completed work will conform to the approved proposed plans and specifications, and the Commissioner of Public Works or Superintendent or his/her duly authorized agent shall do likewise for sewers which will not become the Town's sewers. The sewer, as constructed, must pass the infiltration test (or the exfiltration test, with prior approval), air testing of pipe, vacuum testing manholes, and mandrel of the main pipe required in the design and criteria requirements for the Town of Webster, before any building lateral is connected thereto. The Commissioner of Public Works or Chief Plant Operator and/or Superintendent of Sewers as applicable shall be notified seven days in advance of the start of any construction actions so that such inspection frequencies and procedures as may be necessary or required may be established. No new sanitary sewers will be accepted by the Commissioner of Public Works or Chief Plant Operator and/or Superintendent of Sewers until such construction inspections have been made so as to assure them of compliance with this chapter and any amendments or additions thereto. The Commissioner of Public Works and Chief Plant Operator and/or Superintendent of Sewers have the authority to require such excavation as is necessary to inspect any installed facilities if the facilities were covered or otherwise backfilled before they were inspected, so as to permit inspection of the construction, at the owner's or contractor's expense.
Plans, specifications, and methods of installation for all sewers constructed within the Town of Webster shall conform to the requirements of this article. Components and materials of wastewater facilities not covered therein, such as pumping stations, lift stations, or force mains, shall be designed in accordance with §
257-25 and shall be clearly shown and detailed on the plans and specifications submitted for approval. When requested, the applicant shall submit, to the Commissioner of Public Works, the Chief Plant Operator and/or Superintendent of Sewers, the Monroe County Health Department and to all other agencies having jurisdiction over same, all design calculations and other pertinent data to supplement review of the plans and specifications. Results of manufacturers' tests on each lot of pipe delivered to the job site shall also be furnished, upon request.
All sewer materials shall be new, free of damage, and in conformance
with these specifications. Pipe that shows signs of damage or ultraviolet
(UV) deterioration will be rejected.
A. Sanitary sewer main. Pipe shall
be:
(1) Polyvinyl chloride (PVC) pipe meeting requirements
of ASTM D-3034, minimum wall thickness SDR 35 and with flexible elastomeric
gasket joint per ASTM D-3212.
B. Force mains. Force mains shall
be PVC SDR-18 or P.E.P. SDR-17, Class 52.
C. Lateral connections. Connections
shall be as follows:
(1) For PVC SDR-35 main, install
PVC four inches, SDR-35 wye. Then install four inches SDR-35 1/8
bend and an approved four inches SDR-35 to four inches SDR-21 adaptor.
(2) For existing sewer main-install
Genco DF-40 cast-iron saddle with alignment flange. A five-inch hole
shall be cored into the existing main and saddle strapped over with
the proper size stainless steel straps. Then use four inches SDR-21
lateral pipe.
(3) No lateral pipes shall extend
into the flow area for the main sewer.
(4) All lateral connections shall
be cradled in crushed stone.
D. Laterals.
(1) Lateral pipe installed within
the public right-of-way limits shall be either polyvinyl chloride
(PVC) pipe SDR-21 pipe or Schedule 40 meeting ASTM D 2241.
(2) Joints shall be "slip sealed" type with rubber
ring for SDR-21, and Schedule 40 shall be glued joints.
(3) Prior to the installation
of a lateral connection to a residence, an entry fee shall be paid
to the Town of Webster Sewer Department and the required permit shall
be issued.
(4) All commercial or industrial
laterals shall be no less than six inches in diameter.
E. Low-pressure sanitary sewers.
(1) Building service connections
from individual grinder pumps to the sewer main should be of 1 1/4
inch PVC pipe and should include a full ported valve (such as a corporation
stop or U-valve) located in the service line to isolate the pump from
the main. Check valves specifically suited to wastewater service should
be provided at or near the pump and at a convenient location in the
pressure service line before it enters the main.
(2) Low-pressure sanitary sewer
systems are the responsibility of the homeowner not the Town of Webster.
A maintenance contract should be obtained from the pump supplier.
F. Special appurtenances. When conditions
arise that require a special design, material and/or construction
method not specified within these regulations, the applicant shall
submit all pertinent information to the Commissioner of Public Works
and/or the Chief Plant Operator and/or Superintendent of Sewers for
review and approval.
Construction and testing of new sewers which will become property
of the Town of Webster's Town-wide Sewer District, direct connections
to the Town-wide Sewer District sewers and work by contractors within
easements shall be inspected by a designated representative of the
Town of Webster Sewer Department or the Town of Webster Engineering
Department. The cost of inspection and testing shall be borne by those
who are relocating these sewers. Construction and testing of other
new sewers within the Town shall be inspected by a designated representative
of the Town. The contractor shall notify the Commissioner of Public
Works and/or Chief Plant Operator and/or Superintendent of Sewers
a minimum of 48 hours prior to performing construction and testing,
so that necessary arrangements may be made for inspection.
All sanitary sewers and extensions to sanitary sewers constructed
at the applicant's expense, after final approval and accepted by the
Commissioner of Public Works and/or the Chief Plant Operator and/or
Superintendent of Sewers, and concurrence by the Webster Town Board,
shall become the property of the Town of Webster and shall thereafter
be operated and maintained by the Town of Webster. No sanitary sewer
shall be accepted by the Town of Webster until four copies of as-built
drawings have been filed with the Commissioner of Public Works and/or
Chief Plant Operator and/or Superintendent of Sewers and said drawings
have been approved. Said sewers, after their acceptance by the Town
of Webster, shall be guaranteed against defects in materials or workmanship
for one year by the applicant. The guarantee shall be in such form
and contain such provision as deemed necessary by the Webster Town
Board, secured by a surety bond or such other security as the Webster
Town Board may approve.
Final acceptance of sewers not constructed by the Town of Webster
contractors shall be granted by the Commissioner of Public Works and/or
Chief Plant Operator and/or Superintendent of Sewers only after approval
of test results which have been certified by a licensed professional
engineer, a letter from a licensed professional engineer certifying
that sewers have been constructed in accordance with standards and
specifications in this chapter, and as-built drawings which have been
prepared by a licensed professional engineer or land surveyor, all
of which have been submitted by the builder of the sewer. Only after
final approval is granted by the Commissioner of Public Works and/or
Chief Plant Operator and/or Superintendent of Sewers may the bulkhead
at the point of connection with the Town's sewerage system be removed
and flow discharged into the Town's sewerage system.
During inspection of sewers, if they are found to be defective
the contractor or homeowner will have 90 days to make repairs. If
he or she refuses to repair, the Town has the option to repair the
defective sewer and charge the contractor or homeowner for said repairs.
Property owners may petition the Town to extend sewers to service
their properties. The cost of said sewer extensions will be the responsibility
of the property owner. The Town of Webster Town-Wide Sewer District
will pay for the usual and necessary engineering for said projects.
When repairs are required and, in the judgment of the Commissioner
of Public Works and/or Chief Plant Operator and/or Superintendent
of Sewers, there is potential for imminent harm, injury, adverse effect
on the sewer system structures or equipment, or endangerment to the
public health, safety, property, or welfare, and time does not allow
for compliance with bidding procedures, the Webster Town Board may
declare an emergency and bypass the bidding requirements in order
to procure those materials and services which are necessary to accomplish
the emergency repairs. The Commissioner of Public Works and/or Chief
Plant Operator and/or Superintendent of Sewers, acting upon the belief
that an emergency exists, shall be indemnified against any personal
liability that may arise in the performance of his duties to protect
the health, safety or welfare of the Town of Webster Town-Wide Sewer
District.
