All articles and sections of the 2016 Subdivision and Land Development Ordinance of the Delaware County Planning Department[1] shall apply, except for Section 819, Recreational areas, that follows:
§ 195-819. Recreational areas.
A.
Community open space and recreational areas shall be located as close to all buildings as possible, with access leading to recreational spaces and community facilities.
B.
All community open space and recreational areas shall be designated on the subdivision and/or land development plan using the following three categories:
LAWN — A grass area with or without trees that may be used for a variety of passive recreational purposes
NATURAL AREA — An area of natural vegetation, floodplain, or steep slopes undisturbed during construction. Such area may contain pathways for passive recreation that link to adjacent greenways or trails.
RECREATIONAL AREA AND COMMUNITY FACILITIES — An area designated for active recreational and community use, including, but not limited to, playcourts, playfields, tot lots, community gardens, or other like type facilities, and related accessory structures.
C.
The amount of land to be devoted to community open space and recreational areas in each development shall be determined by applying the following formula as depicted in Table 8-7 to the total acreage of the development.
D.
Steep slopes, wooded areas, and floodplains may make up as much as 33 1/3% of the required community open space and recreational area. A minimum of 50% of the community open space and recreational area shall be relatively flat, dry ground not exceeding 5% slope and suitable to the intended purposes.
E.
In the event that Upland Borough does not assume ownership of the community open space and recreational area, the landowner shall be responsible for maintaining all community open space and recreational areas.

F.
In the event that the landowner chooses to pay a fee-in-lieu of providing open space and recreational acreage, such recreational fee-in-lieu shall be in accordance with the Upland Borough Comprehensive Fee Schedule.
