GENERAL REFERENCES

Pursuant to Article 14B, Sections 370, 371, 372, 373 of the General Municipal Law, the Town Board of the Town of West Seneca hereby authorizes the Justice Court of the Town of West Seneca to establish a Traffic Violations Bureau to aid said Court in the disposition of traffic offenses and violations when such offenses shall not constitute a traffic infraction known as speeding or a misdemeanor or felony.
Said Bureau shall be in the charge of such person or persons and shall be open at such hours as the Justice Court of the Town of West Seneca may designate.
Said Traffic Violations Bureau so established is authorized to dispose of traffic violations of traffic laws, ordinances, rules and regulations of the state or local laws when such offenses shall not constitute the traffic infraction known as speeding or a misdemeanor or felony, by permitting a person charged with an offense within the limitations herein stated to answer, within a specified time, at the Traffic Violations Bureau, either in person or by written power of attorney as herein prescribed, by paying a prescribed fine and, in writing, waiving a hearing in Court, pleading guilty to the charge and authorizing the person or persons in charge of the Bureau to make such a plea and pay such a fine in Court.

A. 
Whenever any motor vehicle owner, operator, chauffeur or driver shall be found by a police officer in violation of any traffic laws, ordinances, rules and regulations, when such offense shall not constitute the traffic infraction known as speeding or a misdemeanor or felony, said police officer may affix to said vehicle a summons, which summons shall contain a notice of the particular violation, directed to said owner, operator, chauffeur or driver, and require such person within 10 days to make payment as required or enter a plea to the Traffic Violations Bureau of the Town of West Seneca.
B. 
Payment may be made in the mailer provided, by certified check or money order, payable to the Traffic Violations Bureau - West Seneca, or in person, at West Seneca Police Headquarters, 1250 Union Road, West Seneca, New York. Payment and acceptance of the prescribed sum by the Traffic Violations Bureau of the Town of West Seneca shall be deemed a plea of guilty to the offense.
C. 
A plea of not guilty may be entered within 10 calendar days by contacting the West Seneca Justice Court, 1250 Union Road, West Seneca, New York (716/674-5600) for scheduling of violation before the Court.
D. 
Failure to make payment or appear and enter a plea within the time prescribed shall result in a criminal summons being issued directing appearance in Court or denial of vehicle registration renewal.
Said Traffic Violations Bureau of the Town of West Seneca shall not be authorized to deprive a person of his right to counsel or to prevent him from exercising his right to appear in Court to answer, explain or defend any charge of a violation of any traffic law, ordinance, rule or regulation.

A. 
All parking violations, as established by state or local law, shall be grouped into three classifications, with the fine established for Class A at $15, Class B at $30 and Class C (handicapped parking) at $75.

B. 
In the event that fines are not paid, or a plea entered, within 10 days, excluding the day of issue, said fines shall be doubled for Class A and B, with Class A fines increased to $40 and Class B fines to $60.

C. 
The Justice Court of the Town of West Seneca shall have authority to designate fines for offenses disposed of by the Court, provided that such fines are within limits established as penalties for such violations.
The Traffic Violations Bureau as herein authorized shall maintain a record of all fines collected and the disposition thereof. It shall also perform such other or additional duties and keep such other or additional records as shall be prescribed by the Court and/or the Town Board of the Town of West Seneca.
All persons who shall appear by written power of attorney must execute the following form and forward to the Traffic Violations Bureau said form, together with their operator's license and the sum prescribed by the Justice Court of the Town of West Seneca:
