The purpose of this chapter is to promote the health, safety and welfare of the citizens of the Town of West Seneca by regulating outdoor fund-raising events to be held by community organizations.
The following words, as used in this chapter, shall have the meanings indicated:
COMMUNITY ORGANIZATION
Any veteran's organization, fire company, fire district or church owning land in the Town of West Seneca.
OUTDOOR FUND-RAISING EVENT
Any outdoor event held by the community organization on its land, which is open to the general public where an admission fee is charged and/or alcoholic beverages are sold.
No community organization shall hold an outdoor fund-raising event without first obtaining a permit from the Building Inspector.
A. 
The application for the permit shall be made at least 21 days prior to the date of the outdoor fund-raising event.
B. 
No event shall be scheduled or advertised until a permit is obtained.
C. 
The application for the permit shall include:
(1) 
The name and address of the organization.
(2) 
The name of the chief executive officer of the community organization.
(3) 
The name of the individual responsible for coordinating the outdoor fund-raising event.
(4) 
The date of the event and proposed hours of operation.
(5) 
The nature of the entertainment. (Live music is permitted.)
(6) 
Whether alcoholic beverages will be sold.
(7) 
Proof of compliance with requirements of New York Liquor Authority.
(8) 
The purpose of the fund-raising.
No music shall be played past 11:00 p.m. at an outdoor fund-raising event, and no event shall be scheduled past 12:00 midnight without prior approval of the West Seneca Town Board.
No community organization shall hold more than three fund-raising events per year without prior approval of the West Seneca Town Board.
All events shall be located on the community organization's property at the location that will have the least impact on any surrounding residential neighborhood.
There shall be no license fee.
Nothing herein shall be construed to prohibit use of land as otherwise permitted in the West Seneca Town Code or Chapter 120, Zoning.
This chapter shall take effect immediately.
