The owners of all homes, properties or structures used or intended to be used for human occupancy, employment, recreation, or other such purposes which are located within 100 feet of any water line or water main which is part of Oakland's water system shall be required at his, her, its or their expense to connect to such water main or water line in accordance with the provisions of this article within 90 days of the date on which official notice of the availability of such water services are made known to said owners by mail from the Mayor and Town Council of Oakland, provided that such water system is available for such connection as contemplated herein.
Connection to said water line shall be in accordance with the specifications promulgated by the Mayor and Town Council of Oakland, and said specifications shall be supplied to the owners of such property with the notice provided for in § 284-23 above.

A. 
Approval/permit: Any property or business owner, owner's authorized agent or contractor who desires to perform fire flow testing, pressure testing, flushing, or desires to erect, enlarge, alter, repair, remove, maintain, convert, or replace any machinery, piping, or any other thing to be connected to, or already connected to, the Town of Oakland's water/sewer system, must receive the Town's signed written approval in the form of a permit to complete such work.
B. 
Exception: Where appliance and equipment replacements and repairs are required to performed in an emergency situation the request for verbal approval shall be immediately submitted to the water/sewer department, and the actual permit as soon as possible within the next working business day of the Department.
C. 
Payment/reimbursement: In the event there is a cost for any of the items noted above, such as employee time, materials, water loss, equipment damage or loss, etc., the property or business owner, owner's authorized agent or contractor who desires to perform or has performed the work, shall pay for or reimburse the Town of Oakland or other property owner/business for any and all costs associated with the work.
D. 
Exempt work. The following work on the interior of buildings/complexes shall be exempt from the requirement for a permit:
(1) 
The stoppage of leaks in drains or vent pipes. However, should the defect necessitate removal and replacement with new material, it shall constitute new work and require the Town's approval.
(2) 
The clearing of stoppages.
(3) 
The repairing of leaks in valves or fixtures.
(4) 
In nonresidential occupancies, the removal and replacement of an existing sink, faucet, showerhead, lavatory, water closet or dishwasher provided the installation does not require replacement or rearrangement of valves or pipes on the Town's side of the water meter and main or sewer main.
(5) 
In residential occupancies, the removal and replacement of an existing sink, faucet, showerhead, lavatory, water closet or dishwasher provided the installation does not require replacement or rearrangement of valves or pipes on the Town's side of the water meter and main or sewer main.
E. 
Exemptions from obtaining the Town's approval required by this code shall not be construed as to authorize any work to be performed in violation of the provisions of this code or any other laws or ordinances of this jurisdiction.
F. 
A violation of this section shall constitute a municipal infraction as defined in Chapter 40 of the Town of Oakland's Ordinances.
(1) 
The penalty for the violation shall be determined by § 40-6 of the Town of Oakland's Ordinances.
(2) 
The violating party or parties shall reimburse the Town or other property owner/business for any damages suffered by and caused by the unapproved work, including but not limited to any manpower, equipment, water loss expenses, etc.
