An annual pension shall be paid to the widow and children upon the death of any member of the Police Department of the City of Garfield, the death of whom has been or shall be occasioned from injuries received in the performance of his duty as a member of said Police Department, as hereinafter provided.
A. 
During that period after the death of such member of the Police Department of the City of Garfield that compensation is being paid under N.J.S.A. 34:15-1 et seq., and the amendments thereof and supplements thereto, commonly designated as the "Workmen's Compensation Act," no pension shall be paid under the provisions of this article.
B. 
After the termination of payments to the dependents of the deceased member of the Police Department under the Workmen's Compensation Act, the annual pension to be paid under this article shall be as follows:
(1) 
If there be a widow of the deceased member and she has not remarried and no children under the age of 16 years, the annual pension shall be $1,200.
(2) 
If there be a widow of the deceased member and she has not remarried and one child under the age of 16 years, the annual pension shall be $1,500.
(3) 
If there be a widow of the deceased member and she has not remarried and two or more children under the age of 16 years, the annual pension shall be $1,800 until such time as all of such children but one shall have attained the age of 16 years, at which time the pension shall be reduced to $1,500 per annum. When such child shall have attained the age of 16 years, the pension shall be further reduced to $1,200 per annum.
(4) 
If the widow shall be deceased or remarried and there shall be one child under the age of 16 years, the annual pension shall be $900.
(5) 
If the widow shall be deceased or remarried and there shall be two children under the age of 16 years, the annual pension shall be $1,200.
(6) 
If the widow shall be deceased or remarried and there shall be three or more children under the age of 16 years, the annual pension shall be $1,800 until such time as all of such children but one shall have attained the age of 16 years, at which time the pension shall be reduced to $900 per annum.
(7) 
No pension shall be paid hereunder to the widow after she shall have remarried or to any minor child after he or she shall attain the age of 16 years.
The pension hereinbefore set forth shall be paid in the manner as follows:
A. 
If there be a widow and she shall have not remarried and has a child or children under the age of 16 years, the pension shall be paid to the widow for the use of herself and such child or children.
B. 
On the death or remarriage of the widow, the pension shall be paid to such child or to such children in equal shares.
C. 
All pensions paid hereunder shall be paid in equal semimonthly installments.
D. 
No pension shall be paid hereunder after the death of the widow and the arrival at the age of 16 years of all of the children of the deceased member of the Police Department.
Eligibility for pension under this article shall be determined as of the date of death of the deceased policeman, but payment shall not start except as provided in § 48-12 hereof.
The governing body of the City of Garfield shall include in the tax levy and cause to be raised by taxation the sum sufficient to pay fully the pensions allowed hereunder.
