An annual pension shall be paid to the widow
and children upon the death of any member of the Police Department
of the City of Garfield, the death of whom has been or shall be occasioned
from injuries received in the performance of his duty as a member
of said Police Department, as hereinafter provided.
The pension hereinbefore set forth shall be
paid in the manner as follows:
A. If there be a widow and she shall have not remarried
and has a child or children under the age of 16 years, the pension
shall be paid to the widow for the use of herself and such child or
children.
B. On the death or remarriage of the widow, the pension
shall be paid to such child or to such children in equal shares.
C. All pensions paid hereunder shall be paid in equal
semimonthly installments.
D. No pension shall be paid hereunder after the death
of the widow and the arrival at the age of 16 years of all of the
children of the deceased member of the Police Department.
Eligibility for pension under this article shall be determined as of the date of death of the deceased policeman, but payment shall not start except as provided in §
48-12 hereof.
The governing body of the City of Garfield shall
include in the tax levy and cause to be raised by taxation the sum
sufficient to pay fully the pensions allowed hereunder.
