As used in this article, the following terms shall have the meanings indicated:
PERSON UNDER LEGAL AGE
Any person under the legal age for purchasing alcoholic beverages as defined by Title 9, Chapter 17B, of the New Jersey Statutes.

No person under the legal age, pursuant to state law, for purchasing alcoholic beverages shall enter any premises licensed for the retail sale of alcoholic beverages for the purpose of purchasing, or having served or delivered to him, any alcoholic beverage.

No licensee or any agent or employee of any licensee shall sell any alcoholic beverage to a person under legal age; provided, however, that the establishment of all of the following facts by a person making any such sale shall constitute a defense to any prosecution therefor:
A. 
That the person under legal age falsely represented in writing in his own hand at the premises on a form approved by the Township Council or by producing a driver's license bearing a photograph of the licensee that he was of legal age or over;
B. 
That the appearance of the person was such that an ordinary prudent person would believe him to be of legal age or over; and
C. 
That the sale was made in good faith relying upon such written representation or production of a driver's license bearing a photograph of the licensee and appearance and in the reasonable belief that the person was actually of legal age or over.

No person under legal age shall consume any alcoholic beverage on premises licensed for the retail sale of alcoholic beverages, or purchase, attempt to purchase, or have another purchase for him any alcoholic beverage.

No person shall misrepresent or misstate his age, or the age of any other person for the purpose of inducing any licensee, or any employee of any licensee, to sell, serve or deliver any alcoholic beverage to a person under legal age.

A. 
No person under legal age shall have, possess, carry, distribute, transport or consume any alcoholic beverage in or on any public park, public place or public building, or in or on any public street, highway, avenue, road or alley, or in or on any vehicle upon any public street, highway, avenue, road or alley in the Township.
B. 
For the purposes of this section, the presence of any alcoholic beverage in any such vehicle shall be presumptive evidence of possession by all persons under legal age occupying the vehicle at the time.
C. 
Nothing herein contained shall be deemed or construed to apply to vehicles owned or operated by or on behalf of a person licensed to sell or otherwise deal in alcoholic beverages for the purpose of delivery to or by such licensee in the course of business.
