No building permit for the construction or erection of a dwelling or other building or structure on any lot shall be issued by the Construction Official unless and until the street upon which such lot abuts has been improved to the point where all utilities are installed and in place, granite curbing, where such curbing is required, is installed and the base course of the roadbed, as required by ordinance, has been laid.
In cases where the topography or other condition of the land requires a substantial amount of fill to be settled and consolidated before construction of the street and the installation of utilities can be undertaken, the Council, upon application, may waive the requirements contained in this article as to any such street or part thereof so affected.
Unless another penalty is expressly provided herein, any person who violates any provision of this article shall, upon conviction thereof, be punished by a fine not exceeding $500 or by imprisonment for a term not exceeding 90 days, or both. A separate offense shall be deemed committed on each day during or on which a violation occurs or continues.
