It has been determined that the presence of large numbers of pigeons on and around the streets and sidewalks in the City of Margate City causes a public health nuisance in and around the City which is inimical to the health and general welfare of the public. It has been determined that the acidity of pigeon waste causes premature rusting and corrosion to the exterior building parts, such as roof flashing, fire escapes, gutters and downspouts. The United States Army Environmental Hygiene Agency has reported that pigeon droppings are an excellent growth medium for organisms of potential human health concern, including but not limited to pulmonary infections and fungal diseases. The purpose of this article is to prevent the feeding of pigeons or creating any condition causing a congestion of pigeons which results in an accumulation of pigeon droppings or damage to plants or property or which results in the threat or nuisance to the public health, safety or welfare.
No person shall intentionally feed, cause to be fed or provide food for pigeons in the City of Margate City, on lands either publicly or privately owned.
Any person or persons violating any of the provisions of this Article II of the chapter shall, upon conviction thereof, be subject to a fine not to exceed the sum of $50. Each and every day such violation continues shall be considered as a separate and specific violation of this article. The penalties herein prescribed shall apply to such separate and specific offenses.
