Pursuant to Section 11 of the Uniform Fire Safety
Act (P.L. 1983, c. 383), the New Jersey Uniform Fire Code shall be locally enforced
in the Borough of Maywood.
The local enforcement agency shall be the Bureau
of Fire Prevention, which is hereby created within the Fire Department
of the Borough of Maywood.
The Fire Prevention Bureau shall enforce the
Uniform Fire Safety Act4 and the codes
and regulations adopted under it in all buildings, structures and
premises within the established boundaries of the Borough of Maywood
other than owner-occupied one- and two-family dwellings and except
as may otherwise be provided by law and shall faithfully comply with
the requirements of the Uniform Fire Safety Act and, to the extent
that it is not inconsistent with said Act or applicable law, the Uniform
Fire Code. Nothing herein is intended nor shall it be construed to
authorize the local enforcement agency to inspect or otherwise enforce
the provisions of the Uniform Fire Safety Act with respect to buildings,
structures and premises owned or operated by the state, its agencies,
departments or instrumentalities, including municipal or Board of
Education properties, or an interstate agency, unless and except as
otherwise mandated by the Uniform Fire Safety Act.
The Fire Prevention Bureau shall carry out the
periodic inspections of high-rise structures or life hazard uses,
as those terms are defined in and are required by the Fire Safety
Act and the Uniform Fire Code, on behalf of the Commissioner
of the Department of Community Affairs. To the extent required in
order to carry out the foregoing responsibilities, the Mayor and Council
may provide, by ordinance, for at least one paid fire inspector or
may contract for the services of an outside fire inspector.
Pursuant to Sections 15 and 17 of the Uniform
Fire Safety Act, any person aggrieved by any order of the Fire Prevention
Bureau shall have the right to appeal to the Construction Board of
Appeals of the County of Bergen.

Registration Fee. All building types and uses (except owner-occupied
one- and two-family dwellings) that are not required to be registered
as a life hazard use in accordance with New Jersey State Fire Code
shall be subject to local registration and fees as follows:

An application permit fee shall be charged at the rate permitted
by the New Jersey Uniform Fire Code, N.J.A.C. 5:70-2.9, as amended,
as of the time the permit is issued by the Borough of Maywood.

Vacancies in the position of Fire Official or
fire inspector shall be filled by the Mayor and Council for the unexpired
term in accordance with the provisions respecting initial appointment.
A report of the Fire Prevention Bureau shall
be made annually to the Board of Fire Officers and transmitted to
the Mayor and Council. The report shall contain all proceedings under
the Uniform Fire Code, a breakdown of all fees collected thereunder,
the number of inspections performed by each fire inspector and such
statistics as the Fire Prevention Bureau may wish to include therein.
The Fire Prevention Bureau shall also recommend any amendments to
the Uniform Fire Code or this article which, in its judgment, shall
be desirable.

Any person, firm, or corporation that fails
to pay the inspection fees called for by § 179-10D or that
fails to comply with a lawful ruling, action, order or notice issued
by the Fire Prevention Bureau enforcing a locally required inspection
shall, for each offense and upon a conviction, pay a fine of not more
than $1,000 and/or serve a prison term not to exceed 90 days, in the
discretion of the Judge. The continuation of each violation for each
successive day shall constitute a separate offense. The person, firm
or corporation allowing or permitting the continuation of any violation
may be punished as provided above for each separate offense.
