As used in this article, the following terms shall have the meanings indicated:
ALUMINUM
All products made of aluminum, including aluminum cans; foil, wrappers, containers for prepared dinners or other foods, screen frames, lawn chairs and house siding.
BROWN PAPER
Paper such as that used in brown grocery bags.
CONSTRUCTION AND DEMOLITION DEBRIS (C/D)
Source separated nonputrescible recyclable material generated from the construction, alteration, repair, maintenance, and/or demolition of structures within the borough. This material shall include concrete, bricks, block, ferrous and nonferrous scrap, asphalt, asphalt shingles, recyclable wood scrap, corrugated cardboard, where practical, and any and all other material generated from the construction, alteration, repair, maintenance and/or demolition of a structure or structures within the borough that is deemed recyclable by this article.
CORRUGATED CARDBOARD
Structural material shaped in parallel furrows and ridges for rigidity, used to make packing and shipping containers.
DESIGNATED RECYCLABLE MATERIALS
Those recyclable materials designated to be source separated in this article or any regulation.
FERROUS SCRAP
All metal scrap containing steel and/or cast iron, including but not limited to steel or tin cans.
FOOD WASTE
Spoiled fruits/vegetables, stale baked goods, meat trimmings and plate scrapings.
GLASS
All products made from silica or sand, soda ash or limestone, which are transparent or translucent and used for packaging or bottling of various matter, and all other materials commonly known as "glass," excluding, however, blue and flat glass, glass commonly known as "window glass," light bulbs, mirrors, drinking glasses, Pyrex-type glass and ceramics.
GRASS
Green herbage sending up spike-like shoots or blades.
HIGH-GRADE OFFICE PAPER
White typing and ledger paper, white notepad paper, copier paper, carbonless computer printout paper, Manila tab cards and file folders.
HOUSEHOLD PAPER
Clean paper other than newspaper and including glossy advertisements and materials, magazines, paperback books, telephone books, bulk mail, cardboard (e.g., cereal boxes with liners removed), soda cartons, cake boxes, greeting cards, envelopes, tissue boxes (with plastic removed), paper napkins, paper towels, paper towel cores, etc., but excluding brown paper (e.g., grocery bags).
LEAVES
Those materials naturally formed from trees and bushes that are suitable for composting and mulching purposes.
MAGAZINES
Includes all magazines or periodicals printed on glossy stock or paper of heavier quality than that commonly recognized as newsprint.
METAL
All products made of metal, exclusive of aluminum, including washers, dryers, refrigerators, stoves, hot-water heaters, tire rims, springs, bicycles, bimetal cans (tin cans) or scrap metal.
MIXED PAPER
Both newspaper and household paper, as defined herein, in a commingled or combined form.
NEWSPAPER
Paper of the type commonly referred to as newsprint and distributed at stated intervals, usually daily or weekly, having printed thereon news and opinions and containing advertisements and other matters of public interest. Expressly excluded, however, are all magazines or similar periodicals as well as all other paper periodicals of any nature whatsoever.
PLASTIC CONTAINER
A container hermetically sealed or made airtight with a metal or plastic cap, with a minimum wall thickness of not less than 0.010 inch and composed of thermoplastic synthetic polymeric material and containers known as "Type 1" and "Type 2" plastic containers.
REGULATIONS
Includes such rules, implementation dates, schedules of times and such other requirements promulgated by the Director of the Department of Solid Waste Management and approved by resolution of the Borough Council as may be necessary to carry out the purposes and objectives of this article.
SOURCE-SEPARATED RECYCLABLE MATERIALS
Recyclable materials, including but not limited to those described herein, which are kept separate and apart from residential, commercial and institutional solid waste by the generator thereof for the purpose of collection, disposition and recycling.
TEXTILES
Any wearing apparel, shoes, handbags, drapes, sheets, bedspreads, blankets and throw rugs, but excluding pillows, mattresses or large carpets.
TOXIC WASTE
Paint, insecticides and automobile batteries.
WHITE GOODS
Shall include used appliances and other large objects made of metal, such as refrigerators, freezers, washers, dryers, stoves, air-conditioning units, metal sheds and large metal cabinets, hot water heaters, barbecue grills, and swing sets.
YARD WASTE
Includes brush, branches, tree limbs and stumps but excluding grass and leaves.

The Department of Public Works is hereby designated the additional title of "Department of Solid Waste Management," and the Superintendent of said DPW shall be and is hereby designated as the Director of the Department of Solid Waste Management.

A. 
All persons who are owners, lessees and occupants of residential properties in the Borough of Maywood shall separate magazines, newspapers, household paper, mixed paper, aluminum, glass jars and bottles and plastic containers (free of foreign materials), construction and demolition debris, ferrous scrap, grass, leaves, white goods, corrugated cardboard, tires (excluding truck tires), waste motor oil, toxic waste, textiles and house-generated batteries from any other trash and garbage produced by any such residence and shall separate and bundle the same for pickup, collection and recycling in accordance with all applicable regulations.

B. 
All commercial property owners, lessees and occupants shall have the same obligations to separate recyclable waste as owners, lessees and occupants of residential property, except that, in addition to the items listed in § 256-3A, the following shall also be separated: high-grade paper. In the case of commercial property, the references to curbside pickup shall not apply. Recyclables shall be placed for pickup, collection and recycling at the regular designated waste disposal site for the commercial enterprise, unless otherwise directed by regulations promulgated pursuant to this Article or state law.

C. 
With respect to all premises not receiving municipal collection services, it shall be the responsibility of the owners, lessees and/or occupants of such premises to contract for the private collection of recyclables in accordance with the terms hereof.

(1) 
Any such person contracting for such private collection of recyclables shall furnish to the Recycling Coordinator the name, address and telephone number of the private scavenger with whom such person has a contract to collect recyclables, the address at which such recyclables are collected and a description of such recyclables. Such information shall be furnished to the Recycling Coordinator annually during the month of January. In the event that there is a change in private scavengers within the calendar year, the person contracting with such private scavengers shall notify the Recycling Coordinator within 30 days following such change.
(2) 
Any scavenger performing private collection of recyclable materials within the Borough of Maywood shall register annually with the Recycling Coordinator. At the time of registration, the scavenger shall furnish the Recycling Coordinator with the following information:
(a) 
The name of the scavenger.
(b) 
The place of business.
(c) 
The telephone number.
(d) 
The name and address of any person holding a ten-percent or greater interest in the scavenger's business or is an officer of such scavenger's business.
(3) 
Each such scavenger shall complete and furnish to the Recycling Coordinator a monthly statement of recyclable materials collected within the Borough of Maywood which shall contain:
(a) 
A list of properties within the Borough of Maywood from which recyclable materials are collected.
(b) 
An estimate of the quantity of such recyclable materials collected from within the Borough of Maywood.
(c) 
The name and location where such recyclable materials are deposited after collection.
(d) 
Such other information as may reasonably be required by the Recycling Coordinator.
(4) 
No person shall collect any recyclable material from within the Borough of Maywood unless such person has registered with the Recycling Coordinator in accordance with the provisions hereof.
All designated separated recyclables shall be placed for pickup, collection and recycling in strict conformity with the following standards:
A. 
Mixed paper shall be separated and either secured in bundles not to exceed 12 inches in height, securely tied with cotton or twine or placed in a receptacle held by the householder and placed at the curb for pickup. Mixed paper shall not be placed in brown paper bags or plastic bags.

B. 
Aluminum cans shall be rinsed and placed at the curb in a receptacle furnished by the householder for pickup.

C. 
Glass jars and bottles shall be rinsed, caps and corks removed, and placed at the curb in a receptacle furnished by the householder for pickup.

D. 
Used motor oil, household batteries and tires, excluding truck tires, shall be brought to the Department of Public Works facilities and deposited in the appropriate receptacles.

E. 
Leaves shall be collected in accordance with Article II of this chapter.
F. 
Other materials, when designated, shall be separated and secured in suitable, reusable containers supplied by the owner, lessee or occupant.
G. 
All recyclables shall be placed at curbside no earlier than 6:00 p.m. on the day preceding the scheduled date for collection. If, for any reason, collection is not made on the scheduled day, such bundles shall be removed from curbside no later than 6:00 p.m. on the day following the scheduled day for collection and held until the next regular collection day.
H. 
Aluminum and ferrous cans, glass and plastics may be commingled for pickup.

I.

J. 
Textiles shall be brought to the facility designated for such purpose and shall be deposited in the appropriate receptacle.

K. 
White goods shall be placed at the curb on the date designated for pickup and collection, which shall be once each month on the day designated by the Director of the Department of Solid Waste Management, in accordance with the rules and regulations adopted in accordance with § 256-5. Each item shall have affixed on it a sticker in the form printed by the Borough. The charge for each sticker shall be $5. Stickers and the right to obtain stickers are not transferrable.

The Director of the Department of Solid Waste Management shall recommend reasonable regulations establishing the commencement dates for mandatory separation of recyclables and the names, dates and times for the collection of the same in accordance with the terms of this article and subject to the approval and promulgation by the Mayor and Council. Such regulations may be approved, modified, repealed or amended, in whole or in part, by resolution of the Mayor and Council. A copy of such regulations, as approved, modified or amended, shall be available for public inspection at the office of the Borough Clerk during regular office hours.
From the time of placement at the curb for pickup, collection and recycling, recyclables shall be the property of the Borough of Maywood or its duly authorized agent. No person unauthorized by the Borough of Maywood shall collect or pick up or cause to be collected or picked up any such recyclables.
No provision herein shall be construed to prohibit not-for-profit or charitable groups or individuals who shall be authorized by the Director of the Department of Solid Waste Management from collecting or picking up recyclables, other than at curbside, in such manner and under such terms and conditions as shall be prescribed by the Director. No such collection or pickup shall conflict or interfere with pickup and collection by the Borough and its duly authorized agent(s).
The Director of the Department of Solid Waste Management or his duly authorized designee is hereby designated and authorized as the enforcement officer of this article.

A. 
Before the issuance of a permit for the demolition of any structure pursuant to N.J.A.C. 5:23-2.17 or other applicable regulation, the person, firm or entity making such application shall post with the Construction Official security in the form of cash, certified check, irrevocable letter of credit or surety bond issued by a surety company authorized to do business in New Jersey. Such security shall be in the amount of $10,000 for one- and two-family homes and accessory buildings and $25,000 for all other buildings. The purpose of the security or condition of the bond shall be to insure that demolition shall have been performed in a good and workmanlike manner as well as to guarantee compliance with § 256-9C of this article, in addition to all other regulations governing demolition. If a bond is posted, the beneficiary of the security or obligee shall be the owner or owners of the land and any persons having an interest in the realty involved on which the demolition is taking place, and the term of any security, be it cash, certified check, irrevocable letter of credit or surety bond, shall terminate no earlier than the expiration date of the demolition permit, plus an additional 30 days.
B. 
This Article shall be applicable to the demolition of any structure and shall include but not be limited to construction debris, demolition debris, roofing debris, trees, including stumps, branches and shrubbery, excavation, such as water main and gas line pipes, ferrous or wood railroad and trolley tracks, pilings of all kinds, houseboats, docks and piers.
C. 
Within five days after completion of demolition of any building or structure, the applicant shall cause to be filed with the Recycling Official of the Borough a municipal recycling tonnage application commercial business form and accompanying documentation. Such form shall be available from the Construction Official and shall be filed with the Recycling Official of the Borough. If any person, including an owner, contractor or builder, during the course of a demolition activity shall discover the existence of recyclable items, same shall be reported and duly documented in accordance with this section, and the Recycling Coordinator shall be notified.
D. 
If within 30 days after demolition of the building or structure, the Recycling Official has not received the required documentation pursuant to this article, and the Construction Official has been notified in writing of the commencement of litigation and the court in which such litigation has commenced and that the said litigation alleges a violation of the purpose or condition of the security or bond posted herewith, the Construction Official shall forthwith transmit such security or bond to the clerk of the court involved for disposition of the matter.

A. 
Any person or firm that shall fail to separate recyclable material in accordance with this article shall be in violation thereof. Each day of such failure shall be a separate offense.
B. 
Any person or firm that shall fail to place at curbside for collection such materials as are required by this article shall be in violation thereof. Each day of such failure shall be a separate offense.
C. 
Any person or firm that shall, without proper authority, collect, take or recycle materials left at curbside (or elsewhere, if authorized) for pickup by the Borough of its authorized agent shall be in violation of this article. Each address from which such collection, taking or recycling was obtained shall be a separate offense.
D. 
Except with respect to the provisions of Subsection C of this section, any person, firm or corporation who shall violate or fail to comply with any provision of this article or of any regulation promulgated pursuant thereto shall, upon conviction thereof, be punished by a fine not to exceed $50 for each offense. Any person, firm or corporation who shall violate or fail to comply with Subsection C of this section shall, upon conviction thereof, be subject to punishment by a fine not in excess of $1,000 nor less than $100 or imprisonment for a term not in excess of 90 days, or both, for each offense.
