A. No person shall operate a multiple dwelling, rooming
house or any rental dwelling unit in the Township unless he holds
an annual valid operating license, issued by the Township of Mount
Holly in the name of the owner of the dwelling unit for the specific
residential multiple dwelling unit, rooming house unit or rental unit,
registering such unit.
B. Conditions requiring license. When any person, partnership,
firm, corporation or entity shall by the use of signs, circulars,
business cards, newspapers, other publications, radio or television
or word of mouth, advertise or solicit the availability of tenancy,
actively or passively, it shall be considered prima facie evidence
of the operation of a multiple dwelling, rooming house or rental unit,
and a license shall be required for the operation of such multiple
dwelling, rooming house or rental unit.
C. Prior to the issuance of such license, the Housing Code Enforcement Officer shall confirm compliance with the provisions of Chapter
90 of the Township Code with respect to inspections of dwelling units for purposes of municipal code compliance.

A. License applications shall be made to the Housing
Code Enforcement Officer and each unit registered with him on forms
provided by the Housing Code Enforcement office.
B. The license application shall contain the following
information and such additional information as the Housing Code Enforcement
Officer deems necessary and appropriate to protect the health, safety
and welfare of citizens of the municipality:
(1) The name and address of the record owner(s) of the
property and the name and address of the operator(s) of the premises,
if different than the owner. The name and address in the case of a
partnership shall be that of a general partner, in the case of a limited-liability
company, that of the managing member, and in the case of a corporation,
that of the registered agent.
(2) The name, address and telephone number of the managing
agent for the premises, if any.
(3) The name, address and telephone number of the custodian,
janitor or building superintendent, if any.
(4) The name, address, telephone number and any other
relevant information of the emergency contact person designated by
the owner or operator to receive notice of, respond to and make decisions
regarding emergencies at the premises.
(5) The fuel source and type of heat provided for the
building, domestic hot water and cooking.
(6) Whether the building is equipped with sprinklers or
other fire suppression systems.
(7) The street address and unit designation for the unit(s)
being registered.
(8) The number of persons which are permitted to occupy
the unit by the owner or operator. The identity of the occupants should
not be supplied.
(9) The number of minors permitted to occupy the unit
by the owner or operator.
(10)
Whether pets are permitted in the unit and any
limitation on nature or number imposed by the owner or operator.
C. For dwelling units subject to registration under N.J.S.A. 46:8-28, the filing of a copy of the registration certificate pursuant to that statute with the application to the Housing Code Enforcement Officer shall be deemed satisfaction of application requirements in Subsection
B(1),
(2),
(3) and
(4) above. Such information need not be duplicated.
D. All information obtained through the licensing process
shall be indexed and maintained by the Township for emergency management
purposes. The Township will share this information with the Mount
Holly Township Fire District and other emergency service providers
as they may request or require.

A. A licensing fee shall be paid for registration of
each dwelling unit as follows:

B. A license issued pursuant to this section shall be
valid for one year or until a change of the beneficial ownership of
the property, whichever comes first.
D. A late fee of $25 shall be charged for any person
for each license not renewed within 10 days of its expiration date
or the change of ownership.

Any person in violation of this article shall,
upon conviction, be punishable by a fine not to exceed $1,000 or imprisonment
for a term of not more than 90 days, or both.
